Mr Checkpoint Discusses LaKeith Smith's Murder Case on Sway In The Morning | SWAY’S UNIVERSE
May 7, 2023
Sennett Devermont, also known as Mr. Checkpoint, is a community activist and founder of Always Film The Police. He recently spoke on Sway In The Morning about the case of LaKeith Smith, a 15-year-old boy who was sentenced to 65 years for the murder of his accomplice during a burglary, despite not having fired the fatal shot. Sennett Devermont’s interview discussed the importance of filming the police, our rights and laws, and the importance of jury duty.
Always Film The Police was created as a means to hold police accountable for their actions, and to clear up any misconceptions the public holds about their rights. Through decades of TV shows like Cops, police have been depicted as noble heroes who serve and protect, but the reality is that many minorities are targeted and treated unfairly. By filming encounters with police, citizens hold them accountable and help change the narrative about the communities they serve.
When it comes to interacting with police, Sennett emphasizes the importance of exercising your rights, but also complying with the law in order to keep any situation safe. He stresses that this can only be achieved with proper knowledge. Sennett creates resources to educate citizens on how to interact with police properly, using your phone, body language, and your words in a strategic way that will help you gain a better outcome.
In the interview, Sennett also talked about the importance of taking jury duty seriously and actively wanting to be a part of it. Although many people view it as a burden, it’s an opportunity to be a part of someone’s life in your community. The more people are knowledgeable, informed and vigilant, the more they can hold police accountable for their actions. By being a part of the jury, every citizen can do their part in creating positive change.
Sennett Devermont’s mission with Always Film The Police is to bridge the gap between police and communities they serve through knowledge and accountability. We must be informed of our rights, understand how to comply with the law, and be proactive about making a difference in our communities. We need to change the conversation from “how to get out of jury duty” to “how can we make a difference." With Sennett’s guidance, we can all play a role in creating a more just and fair world.

I never would have known what our people
0:03
were going through had you not given me
0:05
notice and so you keep doing what you're
0:07
doing
0:07
ATP a-f-tp
0:10
a-f-t-p I appreciate you thank you love
0:14
you wow man um that that was a clip
0:17
taken from the Instagram of our next
0:19
guest aftp means always film the police
0:21
and that's the foundation that he
0:23
started this man literally puts his life
0:25
on the line every day for the rights of
0:27
people in the community I started
0:29
following his Instagram at one point I I
0:31
don't even know why I started following
0:33
it but I thought it was really
0:34
interesting what he was doing he goes by
0:36
the name of Mr checkpoint that says um
0:38
pseudonym had to be because he start
0:41
making people aware of different police
0:42
checkpoints in their community so they
0:44
can know when they're in a lot of times
0:46
in these checkpoints specific
0:48
demographics are being targeted by these
0:51
organizations as I call it man his real
0:53
name is Senate devermont but AKA missed
0:57
the checkpoint and he's been an advocate
0:59
to this case about the Keith Smith who's
1:01
a 15 year old who was caught stealing
1:03
video games in the unoccupied spaces and
1:06
one of the people he was with a young
1:08
man by the name of adante adante
1:11
Washington a Dante Washington was
1:13
actually shot and killed shot in the
1:15
back and as a result the Keith was taken
1:19
on trial uh he was shot and killed by a
1:22
police officer in the back of Dante was
1:24
and when the Keith went to trial he was
1:27
sentenced at 15 years of age to 65 years
1:31
in prison and since then it's just been
1:33
an outrage in that community and Senate
1:37
aka Mr checkpoint has been advocating to
1:40
get that sentence overturned it has been
1:43
reduced to 30 years by a very
1:45
questionable judge and we're going to
1:48
get into that as well but our purpose
1:50
today is to bring more awareness to Lake
1:52
Smith's case so citizens as we do on
1:55
this show were all about was fair we're
1:58
all about our rights our personal rights
2:00
in the community we're all about
2:01
utilizing this platform to bring these
2:04
questions to mind to make you aware of
2:06
things because these things can and will
2:09
affect you and will affect and impact
2:12
your lives and your community some of
2:14
these judges uh don't need to be on the
2:17
stand we always talk about vote quadrant
2:19
Mike Muse created this initiative to
2:21
teach you how to vote on local and local
2:23
areas so you can make sure the right
2:25
people are appointed to the right jobs
2:27
and so I want to welcome him to the show
2:29
give him a big round of applause Senate
2:31
devermont aka Mr checkpoint right now
2:34
yes yes yes yes yes yes
2:37
and if you feel like you've experienced
2:40
some injustice and you want to talk
2:42
about your story please call up
2:46
888-742-3345 also joining him is my
2:49
sister a great friend of mine uh someone
2:52
who's been you know steadfast in the
2:54
community for years yeah I met her in
2:57
the Bay Area a lot of people know her as
2:59
being Tupac's first manager and really
3:02
really just helping him develop as a
3:05
human being and get his his purpose and
3:08
his calls out at an early age as a
3:10
teenager uh she was the person that
3:12
would take him around Community stages
3:14
and allow him to speak his truth to a
3:16
lot of kids who were very influenced by
3:19
him and made him and he was extremely
3:21
relatable around that same time I've
3:24
actually done work with her as well as a
3:26
young man and then she we went around to
3:29
different Community areas and spoke to
3:30
kids in a similar fashion she also is
3:33
known for managing Earl Sweatshirt she's
3:36
the founder of aim for the Heart
3:38
Foundation right
3:40
um and in there A lot of times when I
3:42
was doing work uh with uh the last smile
3:46
with Chris ratliffs and the bad parenti
3:48
organization we would go to different
3:49
places like San Quentin she was already
3:52
there she's been going to places like
3:54
San Quentin since the early 90s and
3:57
through poetry and art has helped people
3:59
uh really just with mental illness with
4:03
expression with just getting through it
4:05
all she's a real Advocate to the
4:07
community 10 toes down she's uh very
4:10
essential in this new docu-series Dear
4:12
Mama that talks about the relationship
4:14
between Affinity Shakur and Tupac Shakur
4:16
the one and only Layla Steinberg is here
4:19
Layla
4:21
Layla Steinberg Tracy here yes yes
4:26
um this is important this is an
4:28
important conversation senate or Mr
4:31
checkpoint what should I call you Mr
4:33
checkpoint Mr checkpoint okay if you go
4:35
on his Instagram you'll just see you
4:37
learn so much I learned so much from
4:39
your Instagram and we've been
4:40
communicating for for a second now about
4:43
this lakif Smith uh conversation who is
4:47
lucky Smith and why should people know
4:49
about this case look Keith Smith was a
4:52
15 year old and he was with a group of
4:54
friends and he was going into unoccupied
4:57
homes and taking video games that's when
5:00
the Alabama police came in and the boys
5:02
ran and unfortunately the Alabama police
5:06
officers Mark Renfro and AJ I'm sorry AJ
5:10
I'm sorry AJ ranfro and Mark Ritter are
5:13
the Alabama police officers that shot
5:14
adante Washington in the back as the
5:17
boys were running late Keith Smith got
5:19
away he later turned himself in and at
5:22
that time he found himself in a
5:24
courtroom with judge Sibley Reynolds and
5:26
was given as you said a 65-year sentence
5:28
for the murder he didn't commit felony
5:31
murder rule allows us to be charged for
5:34
murders we aren't responsible for if
5:36
we're in the act of committing a felony
5:38
and in Alabama specific it's very it's
5:42
very it's written specifically that the
5:43
person who commits the murder supposed
5:45
to be a participant of the crime so it
5:47
asks us if the Alabama police officers
5:49
are participants of the crime I think we
5:51
would all say no so the idea that the
5:54
Keith Smith's being charged for the
5:55
murder that the cops committed is really
5:58
that law being misapplied and abused in
6:01
Alabama
6:02
and uh we are fighting every day his
6:06
family and his mom brontina Smith has
6:08
been fighting for over eight years to
6:11
bring awareness to his case and uh just
6:14
three four weeks ago we had a
6:16
resentencing hearing and that same judge
6:18
Sibley Reynolds came out of retirement
6:20
to hear see a courtroom full of
6:23
supporters who traveled all over the
6:25
country including chairman Fred Hampton
6:27
Jr Jacob Blake senior family of Brianna
6:30
Taylor a pastor uh adante Washington's
6:33
father Andre testified and said lakeith
6:35
isn't responsible for my son's death
6:37
lakeith should be home with his family
6:39
lakeith has been in a Maximum Security
6:42
Prison a level five level six prison in
6:45
Alabama that's like a death camp they
6:48
are violent he is with people who have
6:50
done heinous crimes and he's never done
6:52
anything violent he's never heard
6:54
anybody he was in a home stealing video
6:56
game so the story and the Injustice of
6:59
La Keith Smith is one that is happening
7:01
a thousand times over every day in our
7:03
country and I think every day needs to
7:06
be like Keith Smith day until he's home
7:07
because if it can happen to him it could
7:10
it could truly happen to anybody well
7:12
you talk about the Injustice let's talk
7:14
about the sentencing that he receives
7:16
from this particular judge judge Sibley
7:19
Reynolds
7:21
Reynolds and other cases in the way that
7:24
she sentenced other criminals who have
7:26
done other type of crimes can you give
7:29
an example of what the Injustice looks
7:31
like in the terms of the key sentencing
7:34
compared to other other cases yeah
7:36
that's a good question so about a year
7:39
before Le Keith's case judge Sibley
7:41
Reynolds heard a guy's case named David
7:43
Carr David Carr beat his girlfriend's
7:46
three-year-old to death
7:48
the three-year-old is dead and David
7:51
Carr was given 15 years in one day by
7:54
judge Sibley Reynolds now fast forward a
7:57
year later on the day La Keith Smith was
8:00
sentenced the 65 years and the same day
8:02
the same courtroom and of course that
8:04
same judge listened to another case of
8:06
28 year old Wesley Phelps Wesley Phelps
8:09
had been in trouble before for abusing a
8:11
minor and this time he was in court
8:13
because he had stolen a car and when the
8:15
cops pulled him over he put them on a
8:17
police chase and he crashed the car the
8:19
car caught on fire and it killed his
8:21
girlfriend in the fire wow
8:24
Wesley Phelps was given three years
8:29
for being responsible for killing his
8:31
girlfriend he has since been free he has
8:34
since been locked up several times and
8:37
while the Keith is spent every day in a
8:39
Maximum Security Prison since he's 15
8:41
years old
8:43
if you can't see the Injustice the
8:46
the two discrepancies of killing someone
8:48
these two individuals are responsible
8:50
for killing someone and
8:53
they were given half the time or
8:56
substantially less the amount of time
8:58
than you gave a 15 year old the Keith
9:00
Smith
9:02
there is really no justification for it
9:05
but what is the explanation does the
9:08
judge even answer to why this
9:10
interesting is just so unbalanced and
9:12
obviously unfair
9:14
the judge was specific in some of these
9:16
other cases when I looked him up he said
9:18
that you know uh David Carr had a good
9:21
support system at home you know after
9:23
killing a three-year-old he could go
9:24
home in 15 years in one day because he
9:26
had a good support system I believe
9:28
judge Sibley Reynolds looked in that
9:30
courtroom with the support Le Keith had
9:32
that again is unusual it's people
9:35
traveling all over the country saying we
9:37
support him we vouch for him we have his
9:39
back I don't think that's happened in
9:42
this judge's courtroom uh many times
9:45
before if at all and he looked at that
9:47
and said Le Keith deserves 30 more years
9:50
I believe it's racism at its core these
9:53
two individuals that I've explained
9:54
Wesley Phelps and David Carr who was
9:56
given three years and 15 years in one
9:58
day for being responsible for killing
10:00
people are white the Keith Smith is
10:03
black they gave a 15 year old they
10:05
charged him as an adult for something he
10:07
did not do
10:09
there's no justice in that I want to
10:12
give out like now so far if you tuned
10:15
into this right if you tuned into this
10:18
Channel and to this show I'm sure this
10:21
story has moved you one way or another
10:23
the purpose of telling this story is to
10:26
send more support uh to bring more
10:29
awareness to bring the public more more
10:31
so involved there's an email address I
10:34
want people who feel like what you just
10:36
heard is wrong I want you to hit up this
10:39
email address and when you hit up this
10:41
email address it will address a ton of
10:44
people including a judge that sentenced
10:46
the Keith right even though that judge
10:48
is uh retired but other judges and other
10:50
officials that need to know about it
10:52
what is that email and tell us how that
10:54
email works so if you go to
10:56
freelakeeth.com free late
11:01
l-a-t-k-e-i-t-h.com freelakeeth.com uh
11:04
it will bring you to a link tree
11:06
essentially which has a couple links one
11:08
is the GoFundMe for the mom
11:10
um but the second link is an email tool
11:12
when you click it it opens up your email
11:14
browser and it's filled out to the
11:16
attorney general uh several judges the
11:19
mayor and a lot of people that we think
11:20
should know about this and be aware uh
11:23
it and you just click send you can edit
11:25
it if you'd like but if you want to just
11:27
send it as is you can and we've had over
11:29
10 000 emails go out in the last three
11:31
weeks we've been fortunate to have
11:34
celebrities start sharing this movement
11:37
and saying La Keith's name Kris Jenner
11:39
is one of those people who sent an email
11:42
um Kim Kardashian has shared it we've
11:44
had the support of Rihanna uh Lil Boosie
11:47
Tyrese and and really many more I mean
11:49
being here is a huge opportunity and
11:52
honor to be able to say the Keith's name
11:54
in this mic and get more people knowing
11:56
about it listen to love and strength to
11:58
his family once again give that email
12:00
again
12:02
freelakeeth.com free luckyth.com that's
12:05
going to be the email tool is in there
12:07
there's also a way where you can click
12:09
on it and you can send lakeith a letter
12:12
directly to him so he needs this support
12:15
you know he's not going to be home not
12:17
you know today or the next day so how do
12:19
we send him support encouragement you
12:21
can write him you can send his his
12:23
family uh some Financial contribution
12:25
which helps them continue this fight and
12:28
uh and send the email wow
12:31
um thank you guys so much for sharing
12:33
out of probably like many of our
12:35
citizens who listen to the show I was
12:37
unaware of this I had no idea and it's
12:39
just blowing my mind because not only
12:42
was this boy at 15 years old sentenced
12:45
to 55 or 60 some odd years
12:49
um I want to know a couple of things how
12:51
was he represented in court you know
12:53
what happens if he does get out do do
12:57
does he go under some sort of like
13:01
mental evaluation like people don't
13:03
think about the trauma after you come
13:05
out of prison just sit there and know
13:07
that you were charged with a crime that
13:09
you did not commit and then thirdly I
13:12
think what we always see sometimes with
13:14
presidents and people getting pardoned
13:17
for non-violent crimes would he fall
13:19
under a category like this since he did
13:22
not commit the crime and how would it
13:24
get to that level for the president to
13:25
be aware no those are all really good
13:28
questions so in terms of the last one
13:30
the pardon I don't believe the president
13:31
can pardon him because this isn't a
13:33
federal case so we're looking for the
13:35
governor kiv okay uh to do that the
13:38
governor Alabama the governor of Alabama
13:39
could pardon him and send him home and
13:42
and do time served
13:44
um the other thing is you know how to
13:45
transition him in his in his counsel uh
13:48
he's represented by attorney Leroy
13:50
Maxwell who's an amazing lawyer in
13:52
Alabama civil rights attorney and we are
13:55
so thankful for his support he's been
13:56
doing an amazing job uh despite you know
13:59
the the actual racism going on in these
14:01
courtrooms
14:03
um what attorney Maxwell presented at
14:06
the res at the re-sentencing hearing
14:07
wasn't even for lakeith to just come
14:09
straight home it was actually for him to
14:11
go into programs for I believe it was
14:14
two years to transition and to do that
14:17
again the judge responded with this to
14:20
say Le Keith deserves 30 years in this
14:22
Maximum Security Prison so
14:26
um we we have been you know really
14:28
working on the support I think Layla's
14:31
non-profit aim for the heart is amazing
14:33
place where people are rehabilitated
14:35
people are able to express themselves
14:38
and I know that um lakeith has been able
14:41
to participate even in Layla's program
14:43
while inside in term and actually is
14:45
writing a poem and and we've tried to
14:47
really Inspire him through that so I
14:49
think you know with Layla and other
14:51
supports of the community we can make
14:53
sure did you also mention that this
14:55
judge he came out of retirement just to
14:57
come back to just to like put his hate
15:00
on National display that's absolutely
15:03
correct he came out of retirement to
15:05
hear lakeith's case you know Vice news
15:07
is doing a documentary about this for
15:10
over one year now and um you know
15:13
they've been interviewing the the D.A
15:15
for example who actually in the
15:16
interview says comments that you
15:18
wouldn't believe leave when
15:20
he says different comments the D.A CJ
15:22
Robinson in the vice interview says that
15:24
if this happened today he thinks that
15:26
the officer's action actions would be
15:28
looked at five times more you know uh
15:31
diligently and did they do the right
15:34
thing was it a Justified killing
15:36
actually but what's interesting is if
15:38
you look at the you know when this
15:40
occurred and when they gave locate the
15:42
65-year sentence that DAC J Robinson's
15:44
comments uh weren't that he actually
15:47
said that LE Keith could have deserved
15:48
200 plus years that the Keith's
15:51
stupidity is why he's in there and he
15:54
made really gross comments that you know
15:56
we're going to keep making sure that the
15:57
people are aware that this is how these
16:00
DA's these prosecutors these judges
16:03
speak talk and think about the people
16:05
whatever happened with the officers are
16:07
they still on duty
16:09
we've heard nothing about the officers
16:11
unfortunately this is eight years ago
16:13
you know it was before George Floyd I
16:15
think the idea that officers are
16:17
unjustly killing people was questioned
16:19
substantially more that the convos
16:22
changed in today's times but you know
16:25
there is I have zero doubt that there's
16:27
been any accountability for those
16:29
officers I wouldn't be surprised if they
16:30
were still officers I would say nothing
16:33
negative has ever happened from them for
16:35
their from them being responsible for
16:36
killing 16 year old adante Washington
16:38
shot him in the back my goodness no
16:41
threat at all running shot him in the
16:44
back and then the Keith is suffering a
16:46
sentence for that which is why Layla
16:49
wanted to come this morning because you
16:50
wanted to talk about it right felony
16:52
murder yeah I mean for me
16:56
that's what the work has always been
16:58
about it's why I work with artists it's
17:01
how do we hit critical mass how do we
17:04
reach people and artists have incredible
17:06
power
17:07
and Dear Mama just came out what would
17:09
Tupac be doing now Tupac would be on a
17:12
mission that every day is lakeith day
17:14
until we bring him home
17:16
and I'm just committed to the work we
17:18
got to do the work every day we gotta go
17:20
to work every day you really believe
17:22
Tupac would be right right here he would
17:25
be fighting it's a
17:27
we have to deconstruct this system and I
17:31
have faith you know we've seen change
17:33
otherwise I would have given up a long
17:35
time ago but the fact that you have us
17:37
on this platform they you have millions
17:40
of people paying attention and that they
17:42
can go to the website and that they can
17:44
sign the paperwork ten thousand is cool
17:47
but we need Millions we need Millions
17:49
right millions and so you know I always
17:52
work with artists I gave the assignment
17:54
to um to all the artists I work with to
17:57
do a song to help us generate awareness
18:01
so I don't know if you guys can play
18:03
yeah they're going to play at the well
18:05
plus we could at the end of this
18:07
conversation we're going to end it with
18:08
one of the songs but I
18:10
definitely
18:13
play them
18:16
artists need to support and get involved
18:19
because they have impact that a lot of
18:21
times conversation doesn't work
18:24
and there are a lot more judges that
18:26
need to be held accountable we um one of
18:29
the things Senate always talks about
18:31
jury duty
18:33
insurers are emotional human beings what
18:36
do jury rooms look like what do jurors
18:38
look like they look more like Senate and
18:40
I than they look like you we have to
18:43
change that we need
18:45
um black and brown people to show up to
18:48
serve
18:49
um to to be in courtrooms to change the
18:53
faces of of what's Happening Le Keith
18:57
was presented in front of all white
18:59
all-white jury right
19:02
um let's give out that email I want to
19:04
continue if you're hearing this and it's
19:06
touching the cord in your in your heart
19:08
and your Consciousness is nothing to
19:11
send the email we we post things on our
19:14
social media every day that mean nothing
19:15
nothing but this will mean something if
19:18
you could send an email
19:19
freeleakith.com
19:22
www.freelakith.com and it's
19:26
l-a-k-e-i-t-h.com and uh it takes less
19:29
than 10 seconds if you see there are
19:31
those emails just flying in right yeah
19:33
yeah and actually I see that yeah so
19:34
people you are sending them you are
19:37
clicking and and it works I mean it
19:39
takes 10 seconds and the email goes to
19:42
those it should and it says the things
19:43
it should if you want to add anything
19:45
please do but that's what's needed all
19:47
hands on deck we need you guys until the
19:50
Keith comes home okay and we're going to
19:52
be talking about this all the time it's
19:53
interesting you bring up jury duty
19:55
because our very own Tracy Jews in New
19:57
York right now you can see her actually
19:58
on the screen she's live with us
20:00
it's summing for jury duty right Tracy
20:03
it was my very very first time and you
20:05
know the common sentiment is dang this
20:08
is such an obligation but when I went to
20:10
jury duty and everything was broken down
20:13
I said no this is my privilege and I
20:16
really understood the power of
20:19
representation and also how at one point
20:21
I would never have been called to jury
20:23
duty all of that so Layla I really uh
20:26
salute you for bringing the importance
20:28
of jury up to to the to our listeners
20:31
you know this is one of the most
20:33
appalling things I've ever heard in my
20:36
life about like it happens every day
20:38
though that's the whole point right
20:40
Keith is is um
20:43
just one example and it's always black
20:46
and brown
20:48
um young people that are caught up in
20:50
the system and
20:52
I really appreciate that you went to
20:54
jury duty yes I did yes I did and I will
20:57
go again I will go again the Keith would
20:59
is 23 now because this happened eight
21:02
years ago
21:03
um Layla 24 he turned 24 March 1st yeah
21:06
wow so still so much of his youth that's
21:09
being spent Behind Bars Layla with your
21:12
non-profit um you had mentioned how late
21:14
Keith was able to utilize art and poetry
21:17
much like Pock
21:19
um I'm so curious if you guys have been
21:22
able to understand a bit of his mental
21:24
state right now and if you're able to
21:27
share that and how art has been a form
21:30
of coping for him
21:33
um I would say Senate probably could
21:35
answer that better than I could but what
21:37
I will say is when you are in a cage you
21:42
are daily getting barraged and it's
21:45
damaging to the nervous system and so
21:48
for me
21:50
um with aim for the heart it's always
21:52
been about emotional literacy and
21:54
emotional healing the Mind follows the
21:56
heart so if you get the heart you can
21:59
take the Mind anywhere and so my focus
22:01
has always been to help people manage
22:04
their pain and and understand their
22:06
feelings and
22:09
to be able to release pain is the
22:12
beginning and so for the Keith to be
22:14
able to process what he's going through
22:16
and to write is super important and
22:19
Senate talks to him every day and
22:22
you know he's a Survivor he is a strong
22:26
young man and and God gave him this this
22:29
Mission and so he stands for so many
22:33
other people he just happens to be who
22:35
we're focused on right now yeah yeah I
22:39
guess to touch on that and to be clear
22:41
lakeith's co-defendants you know we're
22:43
given 17 years to 28 years one of them
22:46
is already home so late was offered a
22:49
25-year plea deal he didn't take it
22:50
because he didn't kill his friend he
22:52
didn't understand saying I was you know
22:55
my friend's murder so it didn't resonate
22:58
he wanted a jury trial an all-white jury
23:00
you know convicted him and he gets 65
23:03
years in terms of his I mean he it's
23:06
it's it's so scary to think he's small
23:09
he's been one of the youngest people in
23:11
this Maximum Security Prison his whole
23:13
life right if you're going to 15 or 24
23:14
year the smallest and youngest nearly
23:17
the whole time I'll read a quote or a
23:19
message he sent me
23:21
um one thing I'll say is he meditates a
23:22
lot he practices like spirituality he's
23:25
very faith-based and and really um you
23:28
know Dives in and he throw you know I'm
23:30
feeling this was after the re-sentencing
23:32
hearing when he found out he was going
23:33
to get 30 years uh or the reduced at 30
23:36
years it said I'm feeling okay I always
23:38
pray for the best and be prepared for
23:40
the worst I knew that I knew that was
23:43
the worst that could have happened and
23:45
we're still moving closer to Freedom so
23:47
I got to take the good with the bad it's
23:48
not over
23:50
you know and he he continues to be
23:52
strong in there
23:54
um despite incredibly violent dangerous
23:57
uh and unsafe circumstances I want to
24:00
give out this email citizens um this was
24:03
important for us to bring to this
24:04
platform we're going to continue to give
24:06
out this email even when our guests
24:08
leave
24:09
um we're going to always bring this up
24:11
until we could find the proper Justice
24:13
for the Keith Smith so you don't have to
24:16
make it doesn't you don't even have to
24:17
leave your chair if this is something
24:19
that you know resonates with you as it
24:22
should because it could be you or
24:23
somebody in your family just send an
24:26
email on your phone right now right now
24:29
while you're listening to this show send
24:31
an email to
24:33
freelakeeth.com
24:36
www.freelakith.com and if you click the
24:39
second link it's the email tool it'll
24:41
open up your email browser and it takes
24:43
10 seconds to send the email I see a lot
24:45
of you doing it right now and it's Mega
24:48
appreciated all the judges receive this
24:51
email and know that we're watching that
24:53
we know what occurred and that we want
24:55
change we want change and if you want
24:57
change
25:00
www.freelakith.com we're going to play
25:03
this song um by an artist by the name of
25:05
jayhoon right I I don't know which one
25:08
you're gonna play but we have louie king
25:10
and Jay Hoon we're going to play think
25:12
okay that's the one you want to play
25:14

25:15

25:17

25:19
incredible and they're donating their
25:21
songs to help us with the cause Okay so
25:23
these songs you can also find on the
25:25
website
25:28
www.freelakithsmith.com I know Heather B
25:30

25:34
I do have to head to Urban view but
25:36

25:38
just I was not aware thank you guys
25:40
thank you so much for everything all my
25:43
friends are just hitting me back like
25:45
what wow so thank you guys so much and I
25:48
think sway thank you because it's
25:51
important that we have this information
25:53
as working voting citizens every single
25:56
day we need to know about things like
25:58
this no matter which states we're in
26:00
because this could be one of ours
26:01
absolutely Heather thank you very much
26:03
thank you guys so much okay y'all stay
26:06
we're gonna take one or two callers
26:07
after we play this song let's start with
26:09
um
26:11
think all right and you can find us at
26:16
www.freelakithsmith.com and we're going
26:18
to take a call or two 888-742-3345
26:21
[Music]
26:24
[Applause]
26:26
oh j-a-e-h-o-o-n we're talking about the
26:29
case of lakeish Smith at 15 years of age
26:31
he was sentenced to 65 years in prison
26:34
for a murder he did not commit he was a
26:36
young man along with another young man
26:38
who were
26:39
um they actually was still in video
26:40
games out of unoccupied homes no one
26:43
where no people were in the homes and
26:45
when caught by the police uh they
26:47
attempted to run and the police shot his
26:49
friend adante yeah but Dante Washington
26:52
in the back and killed him and the Keith
26:55
was sentenced for the murder to 65 years
26:59
by a judge by the name of Judge Sibley
27:02
Reynolds the same day
27:04
there was a criminal in the court room
27:06
who had committed murder directly right
27:10
yep
27:11
um can you speak to that Wesley Phelps
27:14
was the 28 year old who had been in
27:15
trouble before for abusing a minor and
27:17
on this time he was in court because he
27:20
stole a car put the police on a
27:22
high-speed Pursuit Chase crashed the car
27:24
caught on fire killed his girlfriend in
27:25
the passenger seat judge Sibley Reynolds
27:28
gave Wesley Phelps three years and after
27:32
giving Wesley Phelps three years he
27:33
looked at La Keith Smith who was 15
27:36
years old stole video games and charged
27:39
him for the murder that the Alabama
27:41
police officers committed in other cases
27:44
that this same judge ruled on where the
27:46
crimes were committed by the actual
27:49
person you spoke about an example of how
27:51
the rulings are unfairly weighted yeah
27:54
David Carr is a gentleman who beat his
27:57
girlfriend's three-year-old to death and
28:00
was given 15 years in one day yeah and
28:03
so the voice you're hearing is uh Mr
28:05
checkpoint that's what he goes by on
28:07
Instagram he does a lot of work in the
28:09
community uh his real name is Senate
28:11
devermont and also Layla Steinberg who's
28:14
with us right now aimed for the heart
28:16
foundation and who's been an advocate in
28:18
the community for years I've known Layla
28:19
for decades and we've done work together
28:21
people knowing from managing Tupac
28:23
Earl's sweatshirt and doing a whole lot
28:24
of stuff inside of Institutions
28:28
um we are trying to spread the word
28:30
citizens if you think this is unfair
28:32
which I'm sure you do you could send an
28:34
email out to
28:37
freelakeeth.com free lakif
28:42
l-a-k-e-i-t-h.com and you click on the
28:45
link there you can send the email
28:46
there's also where you can send lakeith
28:48
a letter himself you can check out the
28:50
family's GoFundMe if the email tool
28:53
doesn't work for a second just try again
28:55
in a minute I think you have a lot of
28:57
people hitting it up I see the emails
28:58
just flying one after another here's the
29:01
thing Xavier is in Tennessee you were
29:03
saying the email list work for you right
29:05
Xavier
29:06
uh so basically I'm trying to put in an
29:09
email you know I know that's in Alabama
29:11
but I'm in Tennessee and it did touch
29:13
some chords here in the heart I wanted
29:15
to send an email but it says that it's
29:17
not ready for my area yet so I wanted to
29:20
know how can I send an email
29:23
it's it should just open up your email
29:25
browser and you should just hit send if
29:28
you go to freelikith.com you hit that
29:31
second link it should not matter where
29:33
you're from in fact there's people uh I
29:35
believe even maybe out of the country
29:37
sending this so I think if if it opens
29:39
up your email browser it should allow
29:41
you to send try it again A lot of people
29:43
are sending email to Xavier and we
29:45
appreciate your com uh your engagement
29:47
brother you're a super citizen Tracy
29:49
Sway in the Morning uh we got rich on
29:52
the line he's our resident attorney and
29:54
um whenever we talk about legal issues
29:57
he he always calls up real Rich tell
29:59
tell these folks what it is that you do
30:02
so I'm a criminal defense attorney so I
30:04
do appreciate what you guys are doing
30:06
currently I want to give a shout out to
30:07
you guys for bringing attention to this
30:09
and for bringing a light to these issues
30:11
that don't necessarily always get the
30:12
attention that they need and I just want
30:14
to address on a couple things you guys
30:15
have said first of all advocacy which
30:18
you guys are doing and the reputation is
30:20
so important revastation goes from the
30:22
bench to the DA's office to the criminal
30:24
defense attorney to the jury and so
30:26
representation matters in the sense of
30:28
legal reputation but also reputation uh
30:31
for a black male in this uh you know
30:33
society in which they view black males
30:35
as criminals and so not only is
30:37
important that there are people that
30:38
look like him and all these different
30:40
spaces but there are people that
30:41
understand or keep in these different
30:43
positions so he can get a fair shot uh
30:46
in speaking to the felony murder law
30:48
which is a horrible law and which allows
30:50
people to consensus for crimes to which
30:52
they not did not commit that is exactly
30:54
why he got what he got because these
30:57
other individuals which I knew exactly
30:59
as he said they got 15 years in three
31:01
years I knew they got plea deals I knew
31:03
they got played down to manslaughter
31:04
which allows them to get lesser charges
31:06
felony murder doesn't allow that and
31:08
that's why there's a flaw in this system
31:10
when the 15 year old kid can be a
31:12
sentence for a crime you didn't commit
31:13
while these people who did commit crimes
31:15
could just admit to them it played down
31:17
to a misdemeanor and get out within
31:19
three or 15 years and so the system's
31:21
law the system needs attention to be
31:22
brought to it you're going to bring
31:24
attention to it right now and that's
31:25
very much appreciated because it doesn't
31:27
always get the attention and needs
31:29
Thank you Rich and and I know Layla that
31:32
was important for you to talk about this
31:34
right yeah always I'm so thankful
31:37
absolutely uh rich thank you man uh we
31:39
appreciate you as always for all that
31:42
you do uh we're talking about the case
31:44
of the Keith Smith who is uh in our
31:47
opinion uh um just unjustly sentenced to
31:50
uh just a tragic sentencing um against
31:53
the case against a crime he did not
31:55
commit he did not murder that man uh
31:57
Dante Dante Washington yeah he was
31:59
stealing video games he's a child the
32:03
the officer should have been charged
32:05
okay and uh so we don't know what's
32:07
going on with the officer but if you
32:10
don't feel like this is fair and you
32:12
tired of it and you're fed up once again
32:14
I want to keep giving out this email
32:17
freeleakith.com
32:19
freelakeeth.com
32:22
l-a-k-e-i-t-h-free lakeith.com Tracy did
32:25
you want to uh add anything to before we
32:27
conclude yeah I mean I mean listen I'm
32:31
still processing this myself Mr
32:33
checkpoint Layla I'm glad that you guys
32:35
have given us all of this information
32:37
but not just information ways that we
32:40
can support
32:41
um
32:42
what would you want you know President
32:44
Biden just announced uh that he is uh
32:48
running for re-election you know what do
32:51
you think I know this isn't a federal
32:54
case so it can't go to a president but
32:57
what should a president be keeping in
33:00
mind now what should we be keeping in
33:02
mind as we vote
33:04
um for our elected officials what should
33:07
we be demanding
33:10
uh I think we need to be demanding less
33:13
announcements and more change more
33:15
action you know it's a lot of saying
33:17
things and it's very little uh action
33:21
being done and I'm definitely
33:23
disappointed in a lot of politicians uh
33:27
for their lack of action in the
33:29
Injustice and criminal Injustice system
33:31
it's disgusting how many people we have
33:34
locked up for crimes that shouldn't be
33:35
locked up for
33:37
including marijuana and other things
33:39
felony murder rules should be abolished
33:41
there's so many reasons and things that
33:43
in my opinion a liberal Progressive or
33:46
Democratic you know president could do
33:49
and change and uh we're just getting
33:51
more announcements so I'd rather some
33:53
change in Real
33:55
uh you know just less words absolutely
33:59
I'm trying to say thank you uh once
34:01
again uh Senate devermont is with us
34:04
Layla Steinberg we've been speaking
34:06
about the case of the Keith Smith who
34:08
was unjustly sentenced to initially 65
34:11
years in prison for hold up on those
34:13
Applause 65 years in prison for a crime
34:16
he did not commit he did not murder of
34:18
Dante Washington
34:20
um and uh it's been reduced to 30 years
34:23
we still feel this unjust he served
34:25
eight already through your engagement
34:27
through your participation we're hoping
34:30
to reverse it all and get him um just
34:33
get him released basically get get him
34:35
free basically get his Freedom right
34:38
yeah I mean any 18 year old any adult
34:40
who did the crime he committed would be
34:43
free now for what he had done any 15
34:45
year old who did what he had done would
34:48
not have done eight years in a Maximum
34:50
Security Prison we just want what would
34:51
happen to anybody else he would be free
34:54
and that's what we want he should be
34:56
home and that's it period we want to say
34:59
send love to his mother his family
35:02
um his friends his mother has been
35:05
outspoken as well right yeah brontina
35:07
Smith she's been fighting this fight for
35:09
over eight years organizing traveling
35:11
across the country bringing people
35:13
around the country together and uh you
35:18
know it
35:19
she's she's she says herself is like he
35:22
did something wrong the time should fit
35:24
the crime right like yes he did
35:26
something wrong he should be held
35:28
accountable but this is not acceptable
35:30
that's not his and uh we want to send
35:32
our love to his mother I believe we
35:34
actually have rontina Smith on the line
35:36
with us right now I want to welcome you
35:38
to the show Brian Tina Smith this is
35:40
sway Calloway Heather B and Tracy G we
35:43
do a show called Sway in the Morning on
35:45
Sirius XM and I want you to know that
35:46
you have our support
35:49
um and bringing awareness to your son's
35:51
case
35:52
um thank you for calling in how are you
35:54
today
35:55
I'm okay and and I'm gonna thank you all
35:57
for giving me the platform on this
35:58
morning all right absolutely
36:00
absolutely what what is it we've been
36:03
over the case we have Senate here we
36:04
have Layla Steinberg or they're here as
36:07
well we've been taking calls from a lot
36:09
of callers from across the country we've
36:11
been really uh promoting the email to
36:13
get people involved uh what is it you
36:15
want the public to know
36:19
well firstly I want the public to know
36:21
that our youth first of all that do
36:23
deserve second chance
36:24
you know
36:26
um
36:26
I want the public to understand that
36:28
people do make mistakes that especially
36:30
young people because we have all made a
36:32
mistake of two in our lifetime I don't
36:35
care who we are we've all done something
36:37
that we can look back and say dead man I
36:40
shouldn't have did that or dead man what
36:41
if I hadn't got caught you know
36:44
um we need to stop
36:45
you know
36:46
um crucified our kids man you know we
36:49
need to you know um Embrace love show
36:51
them love you know show them this angles
36:53
and let them know you know
36:55
that it's not over
36:57
life's not over as 15. you know
37:01
um
37:02
I think that the public
37:04
should
37:06
I don't know like just love on our kids
37:08
more you know I know that we do what
37:10
some do and you know also I think the
37:13
public should you know help out single
37:15
mom as much as you can
37:17
you know because sometimes we can't
37:18
always watch what our kids do and and if
37:21
you see them out there you know doing
37:23
the right thing instead of scalloping
37:25
them you know like talk to them like
37:26
young adults or talk to them the way
37:28
that you don't want a person to talk to
37:30
you or your kid
37:33
you know
37:34
um
37:35
it's
37:38
we just have to do a better job and we
37:41
have to communicate better without you
37:43
to understand what's going on in their
37:46
minds because y'all you know we know
37:47
it's a lot of stuff going on with these
37:49
young people and we're like hey what the
37:51
heck what the hell we don't know you
37:53
know so we need to try to find a way to
37:55
to get to him
37:57
yeah yeah can you tell us about the last
38:00
time you had a chance to speak to lakit
38:02
how is he doing uh what can you tell us
38:05
about him and even being in the
38:07
condition and circumstances at that he's
38:10
in how has he evolved
38:12
right
38:14
I got you um talked about or two ago and
38:18
he he's the most humble person
38:20
even in this situation he knows that we
38:23
are out here with our boots on the
38:25
ground he is very hopeful
38:27
um
38:29
he's
38:30
you know he um and it's crazy because
38:33
you would think that you know in a
38:36
situation
38:37
that he's in
38:40
um
38:41
you should be able to account to be kind
38:43
of down but he was never it still is
38:45
never down even in the day um after the
38:48
the sentencing you know I it broke my
38:50
heart
38:51
one because I saw a look on my son's
38:53
face it was kind of like you know like
38:56
despair to whatever but then once I
38:59
spoke with him you know and it was
39:01
shared with me it was like I'm talking
39:03
to a man you know and he said Mom I I
39:06
know y'all got me I know y'all I have
39:07
fighting for me it was just like a you
39:10
know like a minor setback I'm okay let's
39:13
just keep going let's keep going and
39:15
here my son say these words to me is the
39:18
only put fire you know onto me oh just
39:22
makes my boots up tight on and I'm just
39:23
ready to go
39:24
but this is the voice of brought Tina
39:26
Smith the mother of the Keith Smith
39:28
who's um then the sentenced to initially
39:31
65 years for murder he did not commit
39:34
um and they got reduced to 30 years and
39:36
this happened when he was 15 years of
39:39
age Tracy you want to ask ask a question
39:41
yeah Miss Smith thank you so much for
39:43
giving us your time we really really
39:46
really just are trying to surround you
39:48
with love
39:49
um
39:50
when an injustice happens it never
39:52
impacts that individual alone it just
39:55
spreads like a disease and touches so
39:57
many and oftentimes we look at sentences
40:01
like this as the entire family has to
40:03
endure the sentence and all I have in my
40:06
mind is how are you coping how for other
40:10
people who are in these circumstances
40:12
and don't know what to do to bring more
40:15
hope into their life to keep their chin
40:18
up you know to believe that there will
40:20
be a reversal of these dire
40:22
circumstances what can you share
40:27
um let me first say you know keep
40:28
praying keep God you know
40:31
only for the circle of people
40:34
um
40:35
that he put into my life you know I
40:38
never stopped talking about my son's
40:40
case about my son's story you know I
40:42
never stopped even when people was like
40:43
you know well that's the law That's the
40:46
Law you know what I mean I I kept
40:48
getting it you know with that that's how
40:50
it is and I was like yo
40:53
um you remember back in the day when
40:54
people black people couldn't sit on the
40:56
back of the bus
40:57
Apostles was tired and she decided she
41:00
gonna sit with the first season and she
41:01
started and like it was like at the
41:03
front of us like how did that go like
41:06
that was a law but it was challenging
41:08
the law was made you know it was it was
41:11
taken away when you when you want to see
41:13
it now right so it's kind of like
41:17
there should be no promising
41:20
two
41:22
I'm looking for the right word
41:24
to go against what you don't believe in
41:26
you know so as for me and my son I'm we
41:30
just stayed fast we just you know we
41:31
stayed praying we just told the story
41:34
and um and for those who are going
41:36
through it don't shut up don't be quiet
41:37
you know keep posting about it you know
41:40
like your your family and friends on
41:42
your Facebook list like the people who
41:43
know you they gonna get tired of it and
41:45
they don't not believe they don't stop
41:46
sharing but guess what
41:48
it only takes one person to share it to
41:51
get a fire to get it going so don't stop
41:54
talking about it keep posting about it
41:55
on social keep talking about it in the
41:57
stores in the mall at the church in the
42:00
club wherever you go just talk about it
42:01
because you don't know who know who and
42:03
you don't know
42:05
you see like you like you just don't
42:07
know so just don't give up y'all like
42:09
like try your best to get your kids home
42:11
like this listen I'm doing it for the
42:14
kids but I'm also doing it for so many
42:15
others girls and boys because that's
42:18
what they locked up get up and boys my
42:20
son was a boy he was 15. so this is this
42:22
fight is not only for my son is for
42:25
the country the nation
42:28
is to first of all stop distilling the
42:31
murder crap is to stop this this law
42:34
that gives police officers a right to
42:36
kill people when they want to because
42:38
things like this could have been the
42:40
escalated very easily
42:42
especially on two boys you know I mean
42:45
we got to stop getting police officer
42:47
news two for one and he kills all
42:49
because that's exactly what it is so
42:51
y'all just just keep first of all keep
42:53
praying over your baby don't wash your
42:54
hands no do not wash your hands don't
42:57
wash your hands man like keep I know I
42:59
can't get on our last night but y'all we
43:01
have to keep praying for them have to
43:02
keep praying over them you know even
43:04
when they're allowed around when they
43:05
didn't oh because I get it
43:08
I get it but y'all we could have we have
43:10
to keep going we have to keep playing
43:12
because without prayer this whole thing
43:13
is just anything anyway
43:15
just keep God keep faith
43:18
brontina Smith I want to send love and
43:20
strength to you and your family we'll
43:22

44:23

44:26
uh what we need to know about our rights
44:28
when confront being confronted by police
44:30
