Daniel Penny, a former U.S. Marine, faced trial for the fatal choking of Jordan Neely, a 30-year-old homeless man, during an altercation on a New York City subway in May 2023. Penny claimed he acted in self-defense after Neely displayed threatening behavior, but prosecutors argued that his actions were excessive and led to Neely's death. Ultimately, Penny was acquitted of all charges.
