Former Olympian and women's rights activist Sharron Davies has hailed the Supreme Court for acknowledging "biological sex" after upholding their definition of a woman.Addressing the court today, Lord Hodge upheld the definition declared under the Equality Act 2010 - and maintained that a woman is defined biologically, not by being transgender.FULL STORY HERE.

Let's talk to the expert on this topic
0:01
It's an expert she never wanted to become, of course, but she has unwittingly become the voice on this
0:07
a former Olympic swimmer, feminist campaigner, Sharon Davis. Morning, Sharon. Now, just explain to our viewers and our listeners
0:16
how significant this ruling would be today and what it would mean for women all over the country
0:23
Yeah, I mean, I wouldn't say I'm an expert. You know, there's some amazing people that have been fighting this battle for Women's Scotland
0:28
have been tremendous over this. sex matters. You know, you've spoken to these guys. My area of expertise is sport. What I can
0:34
tell you is that if we in law turn around and say that a six pound piece of paper changes your
0:40
biological sex, then women's rights will just disappear overnight. You know, decades of fighting
0:45
for equality and opportunities in sport and, you know, for lesbians to be able to meet male free
0:51
for rape crisis centres to be able to keep men out of those spaces, all of that will be gone
0:57
And it's a six pound piece of paper. I mean, it's ridiculous
1:01
And you don't even need to have any surgery, take any treatments, change your clothes, do anything
1:08
You just literally have to say that you feel like a woman and you living as a woman Well what is living as a woman I mean it a ridiculous question nowadays You know what we need to be doing is saying that we don have stereotypes and that you can be a male and be as feminine as you want to be
1:23
And you can be a female and be as masculine as you want to be. But biological sex is biological sex
1:28
Professor Robert Winston was on Question Time and he said categorically as a scientist, a human being cannot change their biological sex
1:36
So I just don't understand how we can be here, really. And, of course..
1:40
If somebody has gone for the full reassignment surgery, they would argue, I am now a woman
1:47
Why are they wrong, Sharon? But to get a gender recognition certificate
1:52
you don't have to do that. And that is... That's it in a nutshell
1:56
And isn't it, Sharon, that you have to live as the opposite sex
2:01
for a certain amount of months? Two years. But it's incredible. Two years now
2:06
So you have to say that you have to say that you've lived. You have to say that you've lived as a woman
2:11
What is living as a woman? I mean, you know, is it the fact that you put a skirt on
2:15
Is that what makes you a woman or that you put your makeup on or you grow your hair
2:19
Or what is it that makes you a woman living as a woman To me I find extraordinary And that is in a sentence to me It very difficult to get my head around It two years of saying you live as a woman living as a woman to me I find extraordinary And that in a sentence to me is very difficult to get my head around It two years of saying you live as a woman
2:31
It's over 18. It's a diagnosis of gender dysphoria. And it's six pounds
2:38
And that's it. And then you walk away with your certificate. And the implications of that, then, is that, say, for instance
2:44
you want to go to a women's refuge. I'm thinking of where we would find particularly vulnerable women that may not want to be around somebody that was born a male
2:54
That would allow you to have access to that. Now, what we're seeing today in the Supreme Court is if the idea that a gender recognition certificate is recognised to that degree in law
3:06
then those people will therefore be able to access those spaces. If today this is overturned as a concept or is ruled not to be legitimate
3:16
then those spaces become once again safe for biologically born women. For biological females. The same with sport
3:26
You know, in the Equality Act, there's Section 195, and that says that sport can be segregated by sex
3:32
Well if we change the definition of sex then we can no longer segregate sport by sex So it will remove all protections that women have to safe spaces or fair sport or even just a biological reality basically
3:48
I hope so. I mean, what I really want to do is to not discriminate against anybody
3:53
I don't want anyone excluded from sport. I just want the biological reality of the body that you have to be..
4:01
It's ridiculous to turn around and say that this isn't the case. I mean, you know, as you mentioned, if someone has gone through a full medical transition, that is extremely different from somebody who literally changes nothing
4:11
But people but males that change nothing can still get a gender recognition certificate
4:15
So this is it's all very muddy and crazy. We just need to come up with better definitions, much clearer situation
4:22
But I cannot for the life of me will ever understand how we can move the word sex to not mean the biological sex that you are, because there are only two human sexes
4:32
You know, every scientist would tell you that a human cannot change their biological sex no matter what surgery they have, no matter what hormones they take
4:39
And if you think about it logically as well, the moment you start taking those hormones, your body will revert back to whatever it actually is
4:46
So if a male is taking estrogen and they can't get hold of estrogen, then testosterone will take over again
