Hey ladies and gentlemen, this is Carmine Sabia for Explain America with breaking news
0:04
out of the January 6th trial for former President Donald Trump. Before we get started, please make sure you like, comment, share and subscribe
0:13
Those little things really help us out and they help our channel continue to grow
0:18
And guys, if you're not watching us on YouTube, it helps us so much
0:21
Just go to that address, youtube.com forward slash at Explain America in the lower right
0:26
hand corner and hit subscribe. It's absolutely free. Donald Trump was trying to get a postponement of his trial today in Washington DC and he's
0:38
facing Judge Tanya Chutkin who is the most aggressive, hardcore January 6th judge that
0:46
there is. Literally, she's handed out the harshest sentences. Sentences that even exceeded what prosecutors were looking for
0:54
So you know, she has to be furious with the Supreme Court decision that gave Trump a lot
1:00
of immunity in this case. Because of that, she cannot set a trial date
1:06
She has said that. She cannot set a trial date. She also said it's likely that whatever she does decide is going to be appealed to the
1:12
Supreme Court. So this was a really banner day for Trump because it looks like nothing in this trial
1:20
is going to happen before the November election which is precisely what Team Trump wants
1:25
I want you to take a look at this report on it and let me know what you think in the comments
1:30
To appeal this whole immunity determination that you were just talking about before there's
1:33
a trial and then the next update said Judge Chutkin said that would be futile to set a
1:38
trial date now and both sides agree. You cannot set a trial date now. They still have to go through the appellate process and I think everyone, judge and both
1:45
parties agrees a trial date is well down the line. But she said we have to set a trial date
1:50
That suggested to me well maybe things are moving more quickly than we assumed. Yeah I did a double take there
1:54
I said how is she going to set a trial date when they still have to go through these appeals. But I think she was just raising it to make sure the parties agreed this is not the time
2:01
to set a trial date. There is not a trial date. There will not be a trial date until at least after these appeals
2:06
So Paula Reid, you're there for us. They've now adjourned this session
2:11
So what happens next? So we're going to wait for the judge to issue her schedule
2:17
It was a possibility that she could give some sort of scheduling dates today but she needs
2:22
to take some time to review what she heard today and decide the path forward
2:27
She's made it clear that the first issue is going to be immunity. So she has to decide how she wants to proceed with that
2:33
Then there are going to be these other questions of how does the Supreme Court's decision about
2:37
obstruction of justice related to January 6th, how does that apply here
2:41
She knows that the defense attorneys are going to try to litigate the legitimacy of the special counsel but it does not appear that she's going to give a lot of weight to that argument
2:49
And then there are also these outstanding questions of discovery. So right now we're going to start waiting to see what Judge Tanya Chetkin says in terms
2:55
of next steps. But it's clear, look, she's not going to completely concede to the defense and the way they want
3:01
to proceed here. But it's really unclear how she's going to lay out this calendar
3:05
The number one goal, though, for the Trump team heading into today was to just try to delay any sort of substantive hearings until after the November election
3:13
It appears that that is probably how it's going to play out
3:17
The hearing is adjourned, at least for this day. So Paula, Ellie, Karen
