This is Anita from Real Estate Crunch.
0:11
You know, one of the things that a lot
0:12
of people they think about when they
0:13
look at real estate, they say, "Oh, you
0:15
know, I want to be able to do real
0:17
estate, but without a real estate
0:19
agent." Fine. If you want to buy a home
0:21
on your own without the real estate
0:22
agent, you can. But if your friend wants
0:25
you to sell their home or your neighbor
0:28
says, "Hey, you're a great salesman. Can
0:30
you help me sell my home?" Then that is
0:33
a whole other and different story. We're
0:36
going to talk today about some of the
0:37
risks of unlicensed real estate deals.
0:40
Because there's a lot of people that
0:40
think that, oh, this should be no big
0:42
deal. I should just be able to do it.
0:44
But the truth is, there are some very
0:46
defining rules when it comes to real
0:48
estate. You know, if you've ever sort of
0:50
like thought about like, "Oh, I could
0:51
sell my neighbor's home." And you say to
0:53
your neighbor, "Oh, let me sell your
0:54
home for you." And you're not a licensed
0:55
real estate agent. That actually is not
0:58
legal. You need to be a licensed real
1:01
estate agent in order to buy or sell
1:03
property. It is not legit. And this
1:06
might surprise a lot of people because
1:08
they might think, well, this doesn't
1:09
really matter at all. But, you know, in
1:11
in almost all states, and I believe it
1:13
is all states, that you need to have a
1:15
license. You have need to be a licensed
1:17
real estate agent. And each state has
1:20
different boards and different things
1:21
that you must do to become a real estate
1:23
agent. So if you really want to sell
1:25
that neighbor's home of yours, first get
1:28
your license and then you can do it, you
1:31
know. So that is really important. There
1:33
can be a lot of financial and profession
1:35
um professional repercussions if you try
1:37
to do this. You know, stepping the world
1:40
of real estate be can be can seem
1:42
thrilling at time, but you know, the
1:45
shortcuts in the industry can lead to a
1:46
dead end. Diving into real estate
1:49
transactions without proper license
1:52
isn't just rulebending. It's a recipe
1:55
for disaster for your finances and
1:57
career and for your own career. And this
1:59
could really impact you in other areas
2:01
of your life. If you begin to try to
2:04
circumvent the licensing rules, you
2:06
could face, you know, you could face
2:07
hefty fines, you know, thousands of
2:09
dollars worth. And you could also be
2:12
sued, you know, by the by the buyer or
2:14
other people if it's not an actual
2:17
transaction that you're supposed to do.
2:18
You could actually go down to as, you
2:21
know, trying to scam or trying to scam
2:23
somebody out of their property. That's
2:25
one of the reasons why they have real
2:28
estate agents is to protect the buyer
2:30
and the seller. And so if you decide
2:34
that you want to try to buy and sell,
2:36
you're going to try to buy and sell a
2:37
property. If it's your own property, you
2:39
of course and you own the property, you
2:41
are legally allowed, you know, to do
2:43
your sellers, you know, sold by the
2:46
owner. But if it's not your property and
2:49
if you're not the owner of the property
2:51
and even if it's your parents' property,
2:53
your cousin's property, your nextdoor
2:55
neighbor's property and you are not an
2:57
agent, you are not legally allowed to
3:00
sell by owner. Of course, you could, you
3:03
know, advise somebody, you could help
3:04
somebody, you know, or or if they wanted
3:07
to sell by owner, you you could, you
3:09
know, advise and help them, but you
3:12
yourself are not legally
3:15
able to act as an agent. And the reason
3:17
is is there's some ethical
3:18
considerations and it's for the
3:20
consumer's protection. If I'm going into
3:23
a a property
3:26
and um I'm considering to buy a home and
3:30
the person I'm talking to, you know,
3:31
there's the owners there and then I'm
3:33
talking to what I think is the real
3:36
estate agent and I have my real estate
3:38
agent there and we think we're
3:40
negotiating between the two real estate
3:42
agents with the owner and we're not. you
3:45
know, that of course has ethical
3:47
concerns and can be concerns also of a
3:49
scam or fraud. So there can be all of
3:52
those concerns, you know, with that, you
3:54
know, so it's really essentially not
3:56
good to do and is not legal. And it goes
3:59
back again that if this is something
4:00
that you really want to do, if you
4:02
really want to be able to buy and sell
4:04
real estate, then go and get your
4:06
license and become board certified. In a
4:08
lot of states, it's not that difficult.
4:11
You need to do some coursework. you need
4:13
to take an exam and you can become a a
4:16
licensed real estate. A lot of people,
4:19
they sell real estate while doing their
4:21
full-time job. They might do real estate
4:23
on the side. They might become a real
4:26
estate agent just because they're, you
4:27
know, interested in real estate. You can
4:29
do it for all those different reasons,
4:31
but do not say that you are a real
4:33
estate agent and try to buy and sell
4:35
property if you are not. My co-author
4:39
James Johnson has written a blog on this
4:41
entitled Risks of Unlicensed Real Estate
4:44
Deals if you'd like to be able to read
4:45
more on this. But we um highly recommend
4:48
and we highly stress that if you are not
4:52
a real estate agent, do not try to pose
4:54
as one and do not try to buy and sell
4:56
property without the proper um legal
5:00
documentation to be able to do so. This
5:03
is Anita from uh Real Estate Crunch.
5:05
Thank you so much for listening. We will
5:07
put a link to James Johnson's blog post
5:10
in the description uh below if you'd
5:12
like to be able to read more on this.
5:14
And um if you'd like to read more,
5:16
there's lots of this on the internet and
5:18
check with your own state. You know, if
5:20
you're if you're not sure, call your own
5:23
um state and they can tell you exactly
5:24
all the rules on this, but um the main
5:28
rule is that real estate, you have to be
5:30
a boardcertified real estate agent to be
5:33
able to sell real estate. Same way that
5:35
if you go to a doctor, you want to make
5:37
sure the doctor passed the board. If you
5:39
go to a medical facility, the nurse has
5:41
or if you're working with an accountant
5:43
that the accountants has passed the
5:44
board that you know, all of these
5:46
different things they that they're all
5:47
boardcertified for a specific reason and
5:50
real estate is one of those. Thank you
