Fannie Willis is the Atlanta based prosecutor in the case against Trump and his allies presumably

Now you may remember this case for the head grand juror, the forewoman, making her rounds

on as many television news shows as would have her, talking about, I don't know, whatever

she was talking about. Laughing weirdly and kind of hinting that Trump should be indicted without actually

saying it. It actually got so bad at one point that the judge had to kind of reprimand her publicly

That being said, what's going on, and I'm going to get to the roadblock in just a second

but I want you to know what's going on first. Willis appears to be, according to two sources, determined to use the very vast, very broad

RICO statutes in the state of Georgia to prosecute Trump and his allies under some kind of racketeering charge

How it works is this, if you can prove that two or more crimes were committed in two or

more states, then they can roll that into a racketeering charge, a RICO charge

That of course is very, very bad. It carries a lot of time in prison if you're convicted on it

And of course, I believe Trump has to get this case out of Atlanta, Georgia and into

regular Georgia because I don't see a way, just like in the Manhattan case, that Trump

is going to be able to get a fair trial in Georgia. The sources say that Willis appears to be determined about this and so does constitutional

scholar John Malcolm. Now here's where the bad news comes in for Fannie Willis

See, John Malcolm is a constitutional scholar. He's also a former federal prosecutor

Now he gave his opinion on this and what he said, and here's the roadblock for Willis

This is an extremely weak case. It's unprecedented that these kind of charges would be brought against the former president

She's already stretching the law, in his opinion, by using Georgia state laws in a federal elections case

Now to try and roll that into a RICO would be really stretching it and it could actually

weaken her case more. Now as Malcolm said, what this could do is have a chilling effect on democracy

If people know they can be prosecuted for just being wrong about something, even if

they didn't lie on purpose, if they can be prosecuted for being political activists attempting

to help their client, well then who's going to sign up to be a political activist anymore

Who's going to sign up to help campaigns? This is a danger to democracy, as the Democrats like to say all the time

This is highly dangerous. What she's doing here is really, really messing with the foundations of how campaigns are
