Hey ladies and gentlemen this is Carmine Sabia for Explain America and the Supreme Court has just
0:05
issued a decision that could be massive for former President Donald Trump. Before we get started
0:11
please make sure you like, comment, share and subscribe and you know guys with this election
0:17
coming up we're going to be bringing you and our members some exclusive news that is members only
0:24
so if you're supporting Trump in this election smash that join button become a member of this
0:28
channel. The Supreme Court today issued a ruling that said basically the government of the United
0:36
States is allowed to go to social media companies and try to get posts removed that they consider
0:43
disinformation. Now the problem with this is they're not just asking like you or I would ask
0:50
they're asking with the pressure of the United States government and that's a whole different
0:55
thing. Now justices Thomas and Alito and Gorsuch they disagreed on this decision and they dissent
1:04
it however conservative justices Roberts, Barrett and Kavanaugh they sided with the liberals on this
1:11
That being said this is to me a bad decision for the first amendment. It's a bad decision for free
1:18
speech. It's a bad decision for conservatives but there is a silver lining to this cloud
1:24
in that it could be a good decision for Donald Trump because if you look at what the court is
1:29
saying they're giving broad powers to the government here. Well Trump in his immunity case
1:36
is arguing broad government powers, broad executive powers. If they follow that line of thinking
1:44
well then they have to extend that to the former president of the United States
1:47
and the executive power he had at the time he did what he did during the election
1:53
So if you follow by that logic while we are smarting at this decision today which I think was
2:00
tremendously incorrect but I will say was decided basically on standing and not on the merits
2:06
even still not a great decision but but the silver lining is it could be fantastic for Donald Trump
2:14
when it comes to immunity. I want you to watch this clip on the ruling and the details and then
2:19
leave me your comments let me know what you think. Evidence before they vote in November. Yeah Ellie
2:25
I want to get your take on that too but we should note to our viewers we did get one a decision from
2:29
the Supreme Court very important one and Ellie you can comment on that one as well. The Supreme Court
2:33
said the White House and federal agencies such as the FBI may continue to urge social media platforms
2:39
to take down content the government use as misinformation. This is viewed as a victory for
2:45
the Biden administration technical if not an important one. Yeah so what do you think. Let me
2:49
talk about this case that just came down the first one today. So you may remember about a year or so
2:54
ago a group of Republican state attorneys general and a group of internet users social media users
3:00
sued the Biden administration. They said you are violating the first amendment when you were during
3:05
COVID primarily during COVID but other issues too when you were reaching out to social media companies
3:09
saying you need to take this post down you need to moderate this post and the question was does that
3:14
violate the first amendment. The Supreme Court has now found by a six to three ruling not your usual
3:18
concern it's actually a cross ideological majority that the people who sued do not have standing
3:25
meaning state AGs and people who may use Twitter or Facebook you don't have enough of an injury from
3:31
this to even bring the lawsuit. So they didn't even reach the first amendment question the first
3:36
amendment merits the Supreme Court just said six to three you're out of luck this lawsuit's no good
3:41
go back to the drawing board. Is that kind of taking a pass on deciding some of the more key
3:46
constitutional issues? It's a procedural off-ramp but it matters I mean standing matters in our
3:51
court you can't just bring a lawsuit because something bothers you or offends you you have to be able to show some tangible injury and just to remind our viewers we saw the Mifepristone the
3:59
abortion medication decision last week I think it was was also based on a lack of standing so
4:05
Supreme Court likes to take these off-ramps if they're there especially when they get into messy issues but for now there's no first amendment violation in what the Biden administration did
4:12
And Jamie I mean this is also interesting as it pertains to the upcoming well the
