K.J. Starks Jr. died on July 22nd after being left in a hot car for five hours, according to police
0:13
At the time, Starks was in the physical custody of a child care worker from a company called Covenant Services
0:20
That company was hired by the state of Alabama's Department of Human Resources
0:24
The employee has since been fired, but could now face more serious consequences
0:28
Even though that individual doesn't have legal custody of the child, they didn't have physical custody of the child and was transporting the child to a scheduled visitation
0:39
So that individual is responsible for KJ and the death. That individual should be prosecuted for negligent homicide for leaving a child in a vehicle in 100 degree temperature for approximately five hours
0:56
No charges have been filed at this time. Ramani says civil litigation is almost sure to follow
1:02
Both the employee, the company, and the state of Alabama are responsible for that debt
1:09
So the individual can be criminally prosecuted and all three of them can be sued civilly
1:15
Ramani says Covenant Services could also lose their contract with the state
1:20
A candlelight vigil will be held for KJ on Friday night, followed by a funeral on Saturday
