'Hung Jury' - Nightmare Scenario Unfolding For Bragg

A hung jury, I think, is probably the best case scenario for Alvin Bragg if it's not an outright acquittal

This case is an absolute disaster and has been from day one. Stretching a misdemeanor that's beyond the statute of limitations and massaging into a federal elections crime

which, by the way, Alvin Bragg has no jurisdiction over, was a doomed case to begin with. The only place you could even pray to get a conviction on a case like this would be

New York, Los Angeles, Chicago, San Francisco, really heavily Democrat populated areas where the

opinion of former President Donald Trump is not fantastic. But if you take this case, if they say this case is not about politics, I say to you this

ask them if this case was moved to say, I don't know

Texas. How they would feel about it. Let's say it was moved to the heart of like Trump country in Texas

How would they feel about the case then? What if it was moved to Iowa? How would they feel about the case then

That tells you they know it's about politics. But what we have here is one legal expert. Now, I've said it's gonna be a hung jury from the beginning

and I could be incorrect and you guys come back here and mock me for it, but I believe that

I'm not a legal expert. This legal expert, he believes that's the best case scenario for Alvin Bragg. Let's take a look

Trust and confidence that we need in it. Andy McCarthy, who is a frequent guest on Fox, wrote a piece that I saw in National Review, quite interesting

He referred to the judge as an undercover prosecutor. What do you think about that

Yeah, the judge Rashad's rulings throughout, really since the indictment, but you know, from the gag order all the way through the evidence that he's let in

I read Andy's piece and he talked about the evidence of Andy Cohen's pleas of guilty to federal election crimes and then

the non-prosecution agreement with AMI, which is the parent company of the National Enquirer. None of those things are relevant whatsoever

in a false business records entry. But I'll also add into Andy's piece that, you know, he also let Stormy Daniels

and all of her salacious testimony come in. All of the hearsay, the mountains of hearsay that

Michael Cohen talked about, because they had to get the conversation with Weisselberg in

That was their only way to even try to get to Donald Trump. And Rashad just let it all come in

And then again, the gag order that I believe is unconstitutional, he's kept throughout and

you know, there's only a week left of it, but Judge Rashad has no profile and courage and

I agree with Andy. He certainly has been a prosecutor's best friend in this case
