Hey, ladies and gentlemen, this is Carmine Sabia for Explain America

and just before the federal prosecutors and Jackie Jack Smith have arraigned Donald Trump again, just before that happened
0:14
Smith got some really bad news about his case. If he was counting on this to help convict Trump, well, he's beat

Before we get started, please make sure you like, comment, share, and subscribe

Those little things really help us out, and they help our channel continue to grow. So last night, the attorney for John Eastman
0:34
Now, I'll explain who John Eastman is real quick. John Eastman was one of the attorneys who was helping Trump in the days leading up to January 6th and beyond
0:44
He was one of the attorneys that was working on the case. Basically, he presented the theory that Mike Pence, the vice president at the time
0:54
could refuse to certify the electors and send them back to the state legislators
0:59
and get a different slate of electors. This was his theory. Now, whether his theory was correct or incorrect, legal or not legal, that's irrelevant
1:07
That was Eastman's theory. He believes while unconventional it was legally sound I not a judge I not a constitutional scholar I don know But what I do know is this His attorney was on Laura Ingraham show last night and he gave Jack Smith some bad news
1:27
Let's check it out. I'm not sure if that's Rudy Giuliani or Mr. Eastman. Well, I don't know, Anderson
1:32
Did you clerk on the Supreme Court? Oh, wait, you didn't. All right, the media can mock John Eastman's legal theory all they want
1:39
But is it evidence of criminality? Now, Eastman made a argument that I wouldn't have made, but one that I disagree with at the time and disagree with now
1:49
But it's not a criminal act to have a novel legal theory about something, even if it's about something like the electors and the Constitution
1:58
Advice given from an attorney used to be sacrosanct, and it usually falls under the attorney client privilege
2:05
But this is just another norm that the left will sacrifice on the altar of getting Trump
2:10
Now, Eastman's lawyer is telling Fox News that he believes Eastman is one of the co-conspirators in the latest Trump indictment
2:16
but that he will never plead guilty to this. Anything related to this
2:21
We're going to take this to trial. Joining me now is that attorney. Co-counsel for John Eastman, Harvey, Silverglade, Harvey, good to see you tonight
2:28
What makes you so confident in your case? Well because the Eastman advice was in the realm of good faith legal advice It was certainly cutting edge It was creative But you know that what good lawyers are supposed to do
2:46
And Eastman's advice was perfectly within the realm of good faith legal advice
2:52
I don't have any doubt about it. I'm sure we can get experts to testify to that, if necessary
2:58
If Eastman is charged, he's going to trial. If he's convicted, he's going to appeal
3:03
We will never, ever make a deal. Well, I don't understand their argument is that he was facilitating a crime with the advice
3:16
And obviously, their interpretation of these statutes and the application of the statutes themselves are novel legal theories without really clear intent established
3:28
So they're guilty of the standard that they're applying to Trump and Eastman, I guess, and the others
3:33
It's crazy. This whole thing has become so politicized that's not even funny
3:42
And it is a blot on the Department of Justice in my view
3:47
I don't think... But the president now is not allowed. Now Easton would have been a fantastic cooperating witness if you trying to nail Trump to the wall He would have been the perfect witness but never ever ever That what he saying There is no chance that he will cut a deal with Jack Smith and the federal prosecutors
4:08
Well, that is fantastic news for Donald Trump, but that's horrible news for Jack Smith
4:13
because Easton would have been the lynchpin, the main witness, the guy
4:18
If you really wanted to get a conviction on Trump, that's the guy that could have got it
4:22
for you in my opinion. Without him, it's going to be tougher, especially if he does charge
4:29
Eastman and Eastman does go to trial and proves that, you know, his theory was legally sound
4:35
or that he just gave advice that he believed was legally sound. That's the thing. A lot of these
4:40
things are thought crimes. You're trying to get into somebody's head as to what they believe is
4:44
true or not, and that's kind of crazy. But that's where we are with this. This is definitely bad
4:50
news for Jack Smith and I'm certain he's smart and over it. Folks, I want your comments on this so please let me know what you think of this story
4:57
