Special Counsel Jack Smith Goes Off The Rails - Unhinged Response To Trump Attorney

Hey ladies and gentlemen, this is Carmine Sabia

for Explain America. And special counsel Jack Smith, or as our former president Donald Trump likes to call him

deranged Jack Smith, has just responded to the Trump response to his issuing or asking for the issuing

of a protective order. That's a lot to say in one sentence

So folks, Jack Smith issued his response to the Trump response about the protective order

that Jack Smith is seeking against Donald Trump. Now I've explained this before, but I'll explain it again

In this case, a protective order is not like a protective order you would get against a spouse

or a deranged ex-boyfriend or something. This is a protective order for the evidence in the case

See, Jackie Jack Smith is worried that Trump might actually defend himself in public

while he's being attacked in public. That's basically what this boils down to

So what Jack Smith did after the Trump team basically said, look, here are our parameters

for what we think a protective order should look like. Smith responds, and what he really wants, it appears

is a complete ban on Trump defending himself using any evidence in the case

So what Trump's attorneys did was they went on TV, or Trump's attorney in this case did

is he went on TV and he did what's called the full Ginsburg

He did all five Sunday shows this Sunday, and he was mounting a defense for his client

in the court of public opinion. And one of the things he said is that Mike Pence

he believes, would actually be a great witness for the defense. Now, the court of public opinion is important here

and it should be recognized in this case because this is not just a legal case

It has massive political ramifications. What Jack Smith is trying to set up

with this protective order is a situation where everybody and their brother's uncle

can take shots and swipes at Trump using this case, and Trump and his attorneys basically can't respond

They just have to take the attacks, and they can't issue a response using anything meaningful

So it's a total handicapping of Trump, not legally, but politically. And so the more Jack Smith does things like this

the more this starts to seem like or appear like, you know, his motive here is political

I'm not casting aspersions on Jack Smith. I'm not saying that his motivation is political

but what I'm saying is you can absolutely understand the argument that people are making

when they say his motivations are political, when what he's asking for right here

would have massive political ramifications. So I think what he's asking for is completely unreasonable

Now, I understand that there are things you can't say, and there's information that you cannot reveal

that could harm the case, but that should be limited and pretty strict

to confidential or classified information. Other than that, Trump and his attorneys

should be free to defend themselves. We still have a First Amendment in this country, Jack Smith

We still have a First Amendment in this country, Democrats. And as much as you wanna erase it for this one single man

understand that we cannot allow that to happen because if you can erase the First Amendment for one person

you can erase it for everybody across the board. If this protective order is put in place

it should be appealed all the way to the Supreme Court if need be, because this is absolutely outrageous
