Hey ladies and gentlemen, Carmine Sabia here for Explain America and federal prosecutor
0:05
Jack Smith's case against former President Donald Trump and his co-defendant Walt Nata
0:11
just took a major hit and it's actually bigger than just this one decision
0:17
Let's get to it, but before we get started, please make sure you like, comment, share
0:21
and subscribe. Those little things really help us out and they help our channel continue to grow
0:26
So the prosecution in the Trump-Nata case, the classified documents case, really wanted
0:32
to have a hearing for Nata on Friday, this Friday coming up, two days from now
0:38
But Trump's team and Nata's team put in a request to delay it until next Friday
0:45
Now the request came because Nata's attorney is actually defending somebody in a January
0:50
6th bench trial that is also scheduled for Friday, so Nata would not have the benefit
0:56
of his counsel this Friday if that case were to take place
1:00
So Judge Eileen Cannon, the Trump-appointed judge that the Democrats are so worried about
1:05
she sided with Trump's team and she sided with Nata and so she moved the hearing until
1:13
next Friday. So it seems like a minor procedural thing, but it's actually a big deal because it can
1:21
be a sign of things to come. See on Monday, late at night, 30 minutes before the deadline, Trump's team put in for a delay
1:29
and that delay could take the trial past the November 2024 election, the presidential election
1:36
And this is a big no-no for the federal prosecutors. They don't want to kick the can that far down the road
1:43
But Trump's team says, and I think correctly, that how is it possible that this man could
1:47
get a fair trial in the political climate that this country's in during a presidential
1:53
campaign when Republicans and Democrats are both going to be hitting him from all sides
2:00
How can you possibly, in that scenario, get an unbiased jury, a fair jury
2:07
Well, it seems like Eileen Cannon's decisions seem to always favor former President Trump
2:14
This is a big problem for the prosecution because, of course, they don't want the decisions
2:19
to favor Trump. And they've been trying to find a way to get Eileen Cannon off the case
2:24
They're looking for red flags, they're looking for decisions that are out of the norm
2:29
And a decision to kick the can that far down the road actually would be out of the norm
2:33
It would be unprecedented to kick the trial that far down the road
2:37
But if you look at what Cannon has been doing, and that's the thing, you kind of read the
2:41
tea leaves. Nobody knows for certain what she's going to do. But if you read the tea leaves somewhat, you can see that decision after decision favors Trump
2:51
So they could actually postpone this trial until after the election. And that's going to rankle the Democrats
2:58
That's going to rankle Jack Smith and his prosecution team because they want this thing
3:02
over with. Remember, Jack Smith said he wanted a speedy trial. They want this done before the election
3:07
What do you guys think? Is Trump going to be favored in this trial
3:11
Would he get some special privileges because he's running for president? Let me know in the comments
3:16
