Hey ladies and gentlemen this is Carmine Sabia for Explain America and Alvin Bragg's case
0:05
is falling apart. Before we get started please make sure you like, comment, share, and subscribe
0:11
Those little things really help us out and they help our channel continue to grow
0:16
So Alvin Bragg has not been able to prove his case against Donald Trump. He has not been able to tie
0:23
former President Donald Trump directly to the payments and the cover-up of the payments to
0:29
Stormy Daniels, the alleged cover-up, because I think calling them legal expenses is actually
0:33
correct. But he hasn't been able to do it according to a legal expert who spoke on CNN
0:39
and what he said is look no matter how much this jury might hate, they might despise Donald Trump
0:46
there might be a Democrat jury or a mainly Democrat jury, but what he said is if you
0:50
can't prove the case, if you can't tie Trump to this, well then you're going to get an acquittal
0:56
and it's starting to see, I'm listening to a lot of legal experts, it's starting to see more and
1:00
more likely that there's either going to be an acquittal or a hung jury here because it was a
1:04
weak case to start with. The witnesses have been backfiring on the prosecution and the case, you
1:11
know, seems to be imploding by the day and yet Alvin Bragg, you know, you don't see him on TV
1:16
you don't see him giving press conferences now, do you? Because his case is getting rocked
1:21
and the jury appears, appears I want to say, to be taking this case very seriously as if they
1:27
haven't made up their minds before they walked in the door which would be fantastic. If Trump's
1:31
getting a fair trial, that is fantastic news. We're going to see what happens here but I want
1:36
you to listen very carefully to what this legal expert has to say and then let me know what you
1:41
think. As always, please remember to like, comment, share and subscribe. I'm Carmine
1:46
for Explain America. We love you guys. God bless you. Take care everybody
1:52
We also have Robert Hirschhorn here with us. He is an attorney and a jury consultant
1:56
and has been walking through every step of this trial with us and Robert, right now the
2:00
cross-examination is happening. Trump's attorney is asking this witness, showing him emails from
2:04
Michael Cohen in 2017 where a Cohen signature block is there and it says attorney, it doesn't
2:10
say fixer which is often what Michael Cohen is known as and he just said it doesn't say fixer
2:14
does it? McConnie confirms no. What do you make of this line of questioning from Trump's attorneys
2:22
Yeah, Caitlin, thanks for having me back. Cases are won and lost on cross-examination, not direct
2:28
examination and the fact that, you know, what he's trying to do is, you know, the whole idea
2:34
the moniker of the fixer, you know, that's not what this case is about. This is an accounting case
2:40
This is a crucial witness. He's an accountant. If anybody did anything regarding how to
2:49
record these records, how to put them in the books, it's the accountants, not Trump and the
2:56
fact that this witness said that he never had direction from Trump to falsify any records
3:02
that's a huge problem for the prosecution's case. Well, and also I imagine this question may be something and the prosecution, I should know
3:10
will get a chance to re-question this witness, but McConnie was just asked if he knows one way
3:14
or another whether or not Michael Cohen actually did legal work for Donald Trump in 2017
3:19
He says, I do not know. Now, we know there are other instances out there, people like Rudy Giuliani
3:25
saying that Michael Cohen wasn't doing any legal work, that he was getting paid, but they're trying to make the point and draw some distance that
3:33
McConnie himself doesn't know and that Cohen was not using a Trump org email account
3:38
a Trump organization email account. He was just using his own personal Gmail. What do you think of that
3:46
Well, look, I also think the prosecution's also using the wrong guy. The guy that the
3:52
prosecution ought to have up on the witness stand is Allen, who's currently in the Cross Bars Motel
3:58
And by the way, if President Trump keeps violating the gag order, he's also going to
4:04
get a little taste of the Cross Bars Motel if he's not careful. So look, here's the point
4:10
This is the only person the prosecution could have that talk about the accounting side
4:14
at least so far. He's the highest one up so far from the Trump org side. He has not provided
4:22
Caitlin, that crucial link between the crime and the defendants either knowledge about it or
4:29
ordering that the documents be falsified. It's a big problem. And I'm telling you
4:34
if they don't fix this problem, what you're looking at is this kind of verdict right here
4:40
of a not guilty, even from a predominantly Democratic jury. They have to follow the
4:46
evidence in the case. And if this if the state doesn't link all this up, they're coming in with
4:51
a not guilty. Yeah, we'll see if that reasonable doubt gap there is created. Robert Ershhorn
4:58
thank you for that. And as
