Hey ladies and gentlemen, this is Carmine Sabia for Explain America and there has been
0:04

It really helps us out. This week, Judge Juan Marchand of New York, he postponed the sentencing of former President
0:37
Donald Trump on his hush money case until after the election. Now a lot of people were speculating as to what the reason for that might be, but Judge
0:46
Jeanine Pirro, you know her from Fox News and the Five, she believes she has the answer
0:52
It's the same answer I gave to you yesterday. It's exactly what I believe
0:57
He thought if he sentenced Trump, it would only increase Trump's poll numbers
1:01
It would increase his support among the people and that could put Trump right back in the
1:06
White House. Well, I believe Juan Marchand, whose daughter fund raises for several Democrat candidates
1:13
does not want Trump back in the White House. And to that end, I think he thought that this was the best idea
1:19
Postpone the sentencing before dropping it on Trump in the middle of an election
1:24
Now it is the right thing to do in my opinion, but I don't think his reasons for doing it
1:29
were because he wanted to be kind to Trump or fair to Trump
1:34
I think he didn't want to assist Trump in the election. That's what I think happened
1:39
I do want you to watch this clip here with Jeanine Pirro and then let me know what you think happened
1:43
So listen to what Jeanine Pirro has to say and then let me know what you think in the comments
1:47
I am stunned. Look, this is a judge who at every turn ruled against Donald Trump
1:54
This is a judge who allowed prejudicial evidence to come in, evidence that had nothing to do
1:59
with the underlying charge. And speaking of the underlying charge, most of it is expired pursuant to the statute of
2:06
limitations bootstrapped and resurrected by another crime that the jury didn't have to
2:10
really identify. And there's a lot of hearsay and there's some privileged information
2:17
Then in the interim is a Supreme Court decision that came out in July that said, hey, you
2:22
have to separate immunity or immunize and privileged testimony from the underlying essence
2:29
of the crimes in this case. And now all of a sudden, Judge Mershawn is saying, well, I don't want to be political here
2:37
I think it's time that we took, you know, took note of the fact that we're in a presidential
2:41
election season. Are you kidding me? This is a political decision made by a judge who said, you know what
2:49
This is a close election. I'm not going to give Donald Trump any kind of advantage here
2:55
That's my interpretation. Based upon a judge who did everything he could, even the verdict sheet in this case is not
3:03
you don't you can't understand it. I've never seen anything like it
3:07
And so now suddenly the D.A., Martha agrees. The D.A. says we're not going to object to his sentencing
3:13
They want to throw him in jail. But they know that this is a case that will that will go in Trump's favor and they don't
3:21
want that to happen. So this is Alvin Bragg. There are so many cases that we've been keeping straight
3:28
But this was this was the hush money case. And you remember that Alvin Bragg basically took something that was beyond the statute
3:34
of limitations and extrapolated it into, I think, 34 counts. It was in the end, which had people outraged back then
3:42
Do you think that they are now looking at this situation and that they got cold feet
3:47
I mean, at one point, Mershawn did say back in the courtroom, you know, it's not lost
3:50
on me that I have someone here who may be the next president of the United States
3:54
Do you think that they just said, you know what, we don't we don't really want this on
3:58
our shoulders? Well, I think that it is inevitable that this case will be reversed
4:04
And I think that maybe Mershawn did everything he had to do, that he allowed in testimony
4:10
regarding a crime that nobody knows what it was and that in the end, they will be able
4:15
to say that Donald Trump is a convicted felon. He's been convicted on 34 counts
4:20
But you know what? We're going to delay the sentencing because maybe if they had this sentencing and Donald
4:26
Trump took an appeal, depending upon how quickly the appellate court wanted to rule on this
4:31
I mean, this is an important case where exigent circumstances would require an appellate court
4:36
to take it up immediately. They don't want to be slapped down either
