hey ladies and gentlemen this is Carmine
0:01
Saia for explain America and I've often
0:04
wondered how a defense attorney can
0:07
defend somebody that they're relatively
0:10
certain is guilty of a of a heinous
0:12
crime I still wonder that after this
0:15
interview before we get started please
0:17
make sure you like comment share and
0:19
subscribe those little things really
0:21
help us out and they help our Channel
0:23
continue to grow and if you're not
0:25
watching us on YouTube please check that
0:28
address in the lower right hand corner
0:29
it's
0:30
youtube.com/ explain amera and hit
0:33
subscribe absolutely free it really
0:36
helps us
0:37
out so here's the
0:41
deal we can't say for sure if if Luigi I
0:45
believe it's ma
0:47
Meloni is guilty or innocent of these
0:50
crimes right innocent until proven
0:51
guilty in the United States and we just
0:53
don't know that the evidence is
0:56
overwhelming that we've been told about
0:58
and I absolutely have my
1:00
opinion I think he's guilty that's my
1:04
opinion and I don't care what you think
1:06
of the insurance industry or CEOs or
1:09
billionaires or anything you don't have
1:11
the right to take someone else's life
1:14
for your perceived grievances you just
1:17
don't it doesn't work that way I mean
1:21
it's just evil I don't care what you
1:24
think your reasons are it's absolutely
1:26
evil and to watch this attorney sit here
1:31
and try and dance and dance about the
1:32
Constitution with CNN host Caitlyn
1:35
Collins as she's nailing him to the wall
1:37
on these
1:38
questions it was really ridiculous to
1:41
watch this dance and I think she did a
1:43
remarkable job of holding him his feet
1:46
to the fire here now I want you guys to
1:49
watch this video and let me know what
1:50
you think in the comments we were inside
1:53
that courtroom of course and we learned
1:55
about what happened in there you're
1:56
fighting extradition for him to New York
1:59
why are you why are you fighting that it
2:01
seems like it's inevitable that that he
2:03
will be sent to New
2:05
York well well that that may be but
2:08
again you know the Constitution and I
2:10
know keep bringing up that word today
2:12
unless we forget about that but the
2:14
Constitution gives you certain rights um
2:17
and um we need to make informed decision
2:20
and the law permits and the Constitution
2:22
permits that somebody in Luigi's
2:24
position um has the opportunity to look
2:26
at evidence um make sure the government
2:30
through a process and that's what we're
2:32
doing so again I've been in this case
2:34
probably about 12 14 hours maybe
2:36
whatever give or take and um I haven't
2:39
seen a speck of evidence uh at all um I
2:43
argue today at the extradition hearing I
2:45
still haven't received details about the
2:48
charges that he's facing in New York I
2:50
heard your um introduction and um uh
2:53
looking into that but so I you know we
2:55
as lawyers need to make informed
2:57
decisions and we need to get our hands
2:59
and eyes on some evidence yeah I mean
3:01
I'm looking at the charges right here
3:03
it's murder a loaded firearm two counts
3:06
of that a forged instrument and criminal
3:09
possession of a weapon as well I mean
3:11
those are the charges from New York I
3:14
mean so you're not is you're fighting
3:15
extradition you're not actually arguing
3:17
that the authorities in New York have
3:18
the wrong guy are
3:21
you uh well I have seen any evidence
3:24
that they have the right guy um I can
3:26
tell you that much so I don't I don't
3:27
know anything about that um you know
3:30
there's uh you identification issues uh
3:33
that are present and so I don't U you
3:35
know like I said this is why I need to
3:37
look at some things and they need to
3:39
convince me you know I I I try to remind
3:42
people and it's a shame that we forget
3:44
about this presumption of innocence that
3:46
the constitution gives all Americans and
3:48
people don't worry about the
3:49
Constitution until they're uh facing
3:52
charges or accusations against them then
3:54
trust me Caitlyn the Constitution
3:57
matters but and of course of course it
3:59
does and I know you you highlighted
4:01
earlier and emphasized innocent until
4:03
proven guilty I understand that but I
4:05
read the criminal or I read the the
4:07
police report from when he was arrested
4:09
he initially gave them a false name and
4:11
then when they asked to confirm his
4:13
identity uh he said that he shouldn't
4:16
have lied to them about it I mean that
4:18
would seem to be that that they do have
4:20
the right person given that he had a gun
4:22
on him he had a fake New New Jersey ID
4:26
that he used to check into a hostel I
4:27
mean is none of that enough for you
4:30
personally to to know that they do have
4:31
the right
4:34
guy well first of all that's a piece of
4:37
paper I know you probably can't tell but
4:39
but I'm 5'6 I could write on that I'm 65
4:43
and all this other kind of stuff so
4:45
that's written on paper what's nice
4:47
about the law is we'll have a hearing I
4:49
can cross-examine Witnesses and find out
4:51
look at reports and find out what they
4:53
have and what they don't have so again
4:55
that's just written on a criminal
4:56
complaint um without getting into the
4:59
details of that um I I don't see any
5:01
evidence of a forgery um you they're
5:03
going to have to at least prove a
5:05
primacia case which is less than the
5:08
Beyond A Reasonable Doubt but I I I need
5:10
to see these things right now I have one
5:12
piece of paper um and again so uh yes Mr
5:15
Dicky have you
