Hey ladies and gentlemen, Carmine Sabier here for Explain America and we have a breaking
0:04
story for you right now that could upend the entire Trump classified documents case and
0:11
a trial may never even happen. Folks, before we get started, please make sure you like, comment, share, and subscribe

Trump's attorneys filed a motion at the last minute with about 30 minutes left to go
0:28
At the last minute on Monday night that we've just found out about. Now this motion, if approved, would delay the trial possibly past the 2024 presidential election
0:38
Now liberals are obviously up in arms about this. They're furious about this, but I'm going to get to the reasons why this is actually
0:45
a really good thing and a wise decision if you believe in a fair justice system
0:51
But let's take a look at this report from CNN. New this morning, Donald Trump's legal team is asking the judge to hold off on setting
1:00
a trial date in the former president's classified documents case. In a late night court filing, Trump's legal team said the presidential election cycle
1:08
and the way they put it is will create extraordinary challenges in the jury selection process
1:15
They want the trial delayed until after the 2024 election, contending that otherwise it
1:19
will be virtually impossible to seat an impartial jury while Trump is running for the White House
1:24
Lawyers for Trump aide Walt Nata are also looking for a delay
1:29
CNN's Paula Reid has much more on this one. Paula, what are you hearing from the special counsel with regard to both of these requests
1:36
OK, Jack Smith has made it clear he wants a quote speedy trial
1:41
He has suggested doing this in December, which feels like it's a ways away
1:44
But given the complexities of this case, that would be indeed a speedy trial
1:49
But the former president has every incentive to want to delay this until after the election
1:54
Now, you can't just tell the judge, hey, it's not convenient for me to do this right now
1:58
You have to make legal arguments. So that's what they're putting forth right now
2:02
They are arguing that this case is going to raise unprecedented questions that will have
2:06
to be litigated. And that will take time. They've also raised this question about whether you can even seat an impartial jury leading
2:14
up to something as consequential as a presidential election. They also laid out about half a dozen other legal challenges that they intend to bring
2:22
in this case. Everything, Kate, from questions about whether these documents were really classified to
2:28
trying to challenge the authority of the special counsel. Now, of course, Trump's attorneys are correct
2:33
How are you going to get a fair trial in the middle of a presidential campaign when mud
2:38
is being slinged on Trump while the campaign is going on? His opponents are going to be hitting him with this
2:46
The Republican primary opponents are going to be hitting him with this. The Democrat opponents are going to be hitting him with this
2:51
And a trial really ties his hands to defend himself in a public forum because the trial
2:56
is ongoing. This is totally unfair. There's almost no way you're going to get an impartial jury during this process
3:02
Delaying it past 2024 is the proper move. But I want to know what you guys think about this
3:07
Is this smart or do you want to get the trial over with? Let me know in the comments
3:11
Also, please, again, like, share, and subscribe. It really helps us out and we really do appreciate it

We love you guys. God bless you. Take care, everybody
