hey ladies and gentlemen this is Carmine

0:04
judge Juan Maran not getting a lot of
0:07
great news since his latest decision
0:09
fell flat before we get started please

0:29
absolutely
0:30
it really helps us
0:32
out look judge Juan Maran is on a
0:35
mission to make his legacy about
0:38
sticking it to Donald Trump that's my
0:41
opinion yesterday he decided that Trump
0:44
was not immune from prosecution and that
0:46
he would not vacate the verdicts that
0:48
were delivered by a Manhattan jury in
0:50
the case brought by Alvin Bragg
0:53
unfortunately for Mr Maron
0:56
president-elect Trump he won the
0:58
election and as one CNN analyst put it
1:02
sorry pal you're not the final word on
1:04
this no there's a place called the
1:05
Supreme Court that really has already
1:08
weighed in and is probably going to
1:09
weigh in again on this
1:11
catastrophe of a ridiculous case when
1:13
you look at the cases that Alvin brag
1:16
has not prosecuted and then you look at
1:18
this case it's absolute Ridiculousness
1:21
it's selective prosecution it's
1:23
political there's no way around it if
1:26
you look at the particulars of the case
1:28
and other cases that that have not been
1:31
prosecuted you can't make a case I don't
1:33
think reasonably against the fact that
1:36
this was political persecution and the
1:38
judge should have saw that and the judge
1:40
should have dismissed it but this judge
1:41
is thinking about his political future
1:44
so there you have it but again he's not
1:47
the final word I want you to listen to
1:49
this and let me know what you think in
1:50
the comments absolutely the right
1:53
decision however this is not the final
1:56
word on that very question what the
1:58
Supreme Court decided is that presidents
2:00
are immune for for actions that were
2:03
taken in their official capacity right
2:06
um president Trump's conduct that he was
2:09
convicted of here was largely in his
2:11
private capacity as a business owner
2:13
however there are a few little bits of
2:15
of evidence that came up in trial that
2:17
involved conversations he had in the
2:19
White House what do you do with signing
2:21
checks talking to Hope Hicks his
2:23
personal aid so how do you handle those
2:24
are those official Acts or not this will
2:26
end up going to a federal court at some
2:29
point to decide question um does that
2:31
mean it goes to the Supreme Court EV it
2:33
could if the Supreme Court takes it on
2:34
now the simple fact is he cannot go to
2:37
jail while he's president of the United
2:39
States that's not me making a moral
2:40
point the law as of right now actually
2:43
says that so a lot of this is an
2:44
academic question likely until after he
2:47
leaves the presidency but um this is a
2:51
thorny area of law that doesn't have a
2:53
lot of president in American history and
2:55
uh everybody's just sort of figuring out
2:57
what have any in believe it or not it
3:00
does not but this this open question of
3:02
how to resolve that immunity question
3:04
