Hey ladies and gentlemen, this is Carmine Sabia for Explain America and Judge Tanya Chutkin
0:06
the U.S. District Judge who is in charge of the Trump D.C. Classified Documents case
0:12
well she just made a decision that has shaken Jack Smith's team and made them pretty furious
0:18
Before we get started, please make sure you like, comment, share, and subscribe
0:23
especially the liking and sharing. Those little things really help us out
0:27
and they help our channel continue to grow. So the judge in the case made a decision just days ago
0:34
to put a gag order on former President Donald Trump that limits what he can say about the case
0:41
and what he can say about people involved in the case on social media, at campaign events
0:46
and the like. Well the Trump team put in an appeal to that and they also put in a request
0:53
to the judge to stay her own decision, to stay her own gag order, and they said that this has
0:59
never been done to any political candidate before, let alone the leading candidate for
1:03
President of the United States of a major party, in this case the Republican Party
1:08
The argument was strong enough that Judge Chutkin looked at it and froze her own gag order. So
1:15
there's a temporary freeze on her own gag order while they present their cases. So Smith's team
1:21
has until October 25th to give her the reasons the gag order should stay in place and then Trump's
1:27
team has until October 28th to respond to what Smith's team writes in their filing. So three days
1:34
between Smith's filing and the Trump team filing to argue against it. So to me a gag order
1:42
especially in a situation like this, is a violation of the First Amendment and this
1:47
is a case that could actually put all gag orders in danger because this could get all the way to
1:54
the Supreme Court and the constitutionality of gag orders at all could be called into question
2:02
and they could be shot down because to a lot of us it's a violation of free speech. Why
2:08
Letitia James is a totally different case but Letitia James goes on social media almost every
2:13
day talking smack on Donald Trump and yet the judge in that case hit Trump with a $5,000 fine
2:20
for talking about somebody that was associated with Schumer, Senator Schumer of New York
2:26
the Senate minority leader who's also involved in this case. So why can Trump not say that but
2:32
Letitia James can go on social media every night almost and talk smack on Trump and present her
2:38
case to the American people but Trump can't fire back? So then this is a one-sided war for the
2:45
public opinion? A one-sided kangaroo court battle in the public square? Is that how they're going to
2:51
do this? They're going to tie Trump's hands and let anybody say whatever they want about him and
2:57
he's not allowed to say anything back? This may have to go to the Supreme Court because we're
3:02
talking about a serious violation of this man's right to speak and to defend himself against his
3:07
accusers and that is a fundamental right in the United States. It seems like they just want to get
3:15
Trump at all costs. Constitution? Don't worry about it. We got to get this man. That's how I believe
3:22
they feel and I don't think they're going to let anything stand in their way. I think this case
3:26
needs to go to the Supreme Court, the gag order portion of it needs to go to Supreme Court ASAP
3:32
It can't go there after the 2024 election is over. It has to get there on an emergency basis
3:38
I want to know what you guys think in the comments so please let me know. Also please remember to like, share, and subscribe. Again that really helps us out
