0:31
helps us out some Democrats are
0:34
celebrating that the Liberals on on one
0:38
of these courts of appeals said no Trump
0:41
can't stop Birthright citizenship well
0:43
of course they said that listen it's
0:46
enshrined in the Constitution the only
0:48
court that was ever going to be able to
0:50
change this and not even change it so
0:53
much as Define it correctly was always
0:56
going to be the Supreme Court and now it
0:58
strongly appears that's where the case
1:00
is headed I would be shocked if that's
1:02
not where the case is headed legal
1:04
experts say that's where the case is
1:05
headed but here's the thing when they
1:07
tell you that Trump lost this he didn't
1:09
he knew that's where it was headed from
1:11
day one the day he made this executive
1:13
order to abolish Birthright citizenship
1:16
enshrined in the 14th amendment that was
1:18
intended for slaves and has been used by
1:20
illegal migrants the day he decided to
1:22
say no no no it doesn't work that way he
1:25
knew this was going to the Supreme Court
1:28
it always had to do that's the only
1:31
court that is tasked determining the
1:33
Constitution the Amendments and what our
1:36
rights are it's the only one it was
1:38
always going to go there and that's what
1:40
this one CNN analyst said much to the
1:43
shrin of their colleagues on the CNN
1:46
panel I want you to look at this video
1:48
and let me know what you think in the
1:49
comments is that the the courts just to
1:52
be clear do not agree with this idea
1:54
that they get to be the final Arbiter
1:56
just tonight the appeals court the ninth
1:58
circuit said uh they're going to keep
2:00
the block on Trump's challenge to
2:03
Birthright citizenship uh it's going to
2:05
remain on hold uh and it's going to go
2:07
to a hearing B surprised that the ninth
2:10
circuit ruled against the president okay
2:11
the ninth circuit just okay is made up
2:14
just so well it's shocking is a judge so
2:16
it's going to the Supreme Court hello
2:18
hang on Robert the ninth circuit is made
2:20
up of a trump appointee a Jimmy Carter
2:22
appointee and a George W bush appointee
2:24
so just so people understand it's
2:26
something in the water though just it is
2:28
yet another example the court are
2:30
stepping in well to a certain to listen
2:32
I was I was a chief executive I was the
2:33
mayor of New Orleans for for eight years
2:35
and I remember saying you know I'm the
2:37
head of this branch of government I I
2:38
want to do X and A lot of times the City
2:41
attorney came in and said Mr Mayor you
2:43
not represent the city I'm not your
2:45
personal lawyer this is what the law
2:47
says this is what the Supreme Court says
2:48
and as a lawyer as an officer of the
2:50
Court you know there certain arguments
2:52
that you can make with in bounds but if
2:53
you go and misstate the law to an appell
2:56
Court to to a supreme court you have an
2:57
obligation to say that's really just
2:59
outside out of the bounds of what we are
3:01
I mean isn't that just common sense
3:03
Brian shouldn't shouldn't it be the case
3:06
that the law says
3:11
