Hey ladies and gentlemen, this is Carmine Sabia for Explain America with massive breaking
0:05
news in one of the Trump trials. Before we get started, please make sure you like, comment, share and subscribe

Those little things really help us out and they help our channel continue to grow

As you guys know, there are closing arguments happening right now in the Trump trial in Manhattan
0:23
Now, DA Alvin Bragg has his closing arguments yet to come. As we speak here, the defense is giving their closing arguments
0:33
But during that time, new news broke out of the Trump trial over the classified documents
0:41
being brought by Jack Smith, the special prosecutor. Now Jack Smith has asked for a gag order on Donald Trump similar to the one that was given
0:50
in Manhattan. This gag order would prevent him from talking about certain witnesses, certain aspects of
0:56
the case and he had to present this to Judge Eileen Cannon, a Trump appointed judge
1:02
Judge Eileen Cannon summarily smacked down that request, did not issue the gag ruling
1:09
denied it. And I think not only is it a victory for former President Trump, but it's a victory for free
1:16
speech in general. These gag orders have been abused as far as I'm concerned, not just in Trump's case, but
1:21
in every case. I find them, and this is just my personal opinion, to be a violation of the First Amendment
1:28
I think that people have a right to free speech, provided you're not actually actively intimidating
1:32
a witness, you know, like Joe Biden might have done just yesterday
1:37
So I want to know what you guys think about it. Let me know in the comments, but I also want you to get the details
1:42
So let's watch this report. Some kind of political impact. We just don't know which way yet. Yeah
1:47
Jake, let's go back to you in DC. Anderson, thanks so much. Right now, there is more breaking legal news involving former President Donald Trump, this
1:53
time in a different case, the classified documents case in Florida. A federal judge has rejected the request from special counsel Jack Smith
2:03
He requested a gag order against Donald Trump. Let's bring in CNN's Caitlin Polans
2:07
Caitlin, tell us more about this ruling, which came just moments ago
2:11
Jake, so prosecutors from the special counsel's office at the Justice Department are not going
2:15
to be able to limit Donald Trump's speech about law enforcement, who were part of that
2:21
Mar-a-Lago search in August of 2022 at this time because they didn't follow the proper procedure
2:27
That's what Judge Eileen Cannon just said moments ago. The prosecutors had gone to her on Friday in the evening, right before the holiday week
2:36
asking her to put limitations on what Donald Trump could say because he was out there talking
2:41
misleadingly about the FBI policies around the use of deadly force, a policy that was
2:46
standard and in place for that search of the resort in Florida
2:52
But Trump was trying to say that he was in danger because of it. That was not true
2:56
So the prosecutors wanted to protect the proceedings, protect their own officers and have a gag order
3:03
They felt that it was a very dangerous situation. So they went to the judge
3:07
Trump's team, though, took issue with this because they said they didn't have enough time to think about this and to respond and meaningfully work with the prosecutors to
3:16
provide some sort of meet and confer. That's what they say in court
3:21
And so Judge Cannon today agreed with Trump's team. She said this was professional, unprofessional and not courteous in the way that the Justice
3:30
Department went about this, coming to her with the gag order request that anything in
3:34
the future, they need to have more time given to the defense team
3:39
And so she's denying they could always try again. But as of now, no gag order for Trump in the Florida case
3:45
All right. Caitlin Pollins, thank you so much. Let's discuss this for a sec
