Hey ladies and gentlemen, this is Carmine Sabia for Explain America, and we have breaking
0:04
news from the Washington, D.C. courtroom of Judge Tanya Chutkin, as she has just delivered
0:09
a massive bombshell ruling in the Trump versus Jack Smith case. Before we get started, please make sure you like, comment, share, and subscribe
0:19
Those little things really help us out, and they help our channel continue to grow
0:23
Judge Chutkin actually sided with Donald Trump. She said it was a close decision, that it was very close, but in the end, she said that
0:33
Smith's team, the special counsel who was prosecuting Trump, did not show enough evidence
0:40
to prove that all of the things they were requesting be covered under a protective order
0:45
umbrella should be protected. Now she did say that of course sensitive information should be protected
0:53
I think that goes without saying, but she said something important in the decision
0:57
She said that the defendant, meaning former President Donald Trump, has First Amendment
1:02
rights to free speech, and that you cannot just destroy them with a protective order
1:07
This is a monumental decision. If this decision had gone the other way, it would have been catastrophic, not just for
1:14
Trump, but for the First Amendment itself and what prosecutors could prevent you from
1:19
doing in your own life if you were being prosecuted. This is a tremendous victory, again, for Trump, for the Constitution, for the First
1:28
Amendment, and I have to say, for my confidence in Judge Chutkin as a judge in this case
1:35
As we know, look, she hasn't really shown in her decisions that she's a fan of Donald
1:40
Trump, and she shouldn't. She's a judge, but some of her decisions, she seems to needle the former president
1:46
and she's been the harshest punisher of January 6th defendants. She's a very tough judge, and she's been very, you know, really, really tough on those
1:56
particular defendants, anybody who was involved in the riot at the Capitol
2:01
She's actually gone above and beyond what the Justice Department has even asked for
2:05
in terms of punishments for January 6th rioters. So for her to issue this decision is a massive blow to Jack Smith, because he thinks, hey
2:15
I got a friendly court here, they're going to do whatever I want, and he just got smacked down in a really huge way
2:20
Don't underestimate how monumental of a decision this is. This sets the tone that, at least right now, it appears, this judge is going to have a
2:29
fair and impartial courtroom, and if that's the case, Jack Smith has grossly miscalculated
2:35
the advantage he has here in D.C. For Trump, you know he's going to be celebrating this
2:39
It is a victory for him, no doubt. He gets to continue to speak freely
2:45
He gets to talk about things in the case. If this had been done, if he had gotten this order, if Jack Smith got this order, that
2:51
meant that Trump's opponents could attack him about the case, Democrat and Republican
2:56
They could keep hitting him and hitting him and hitting him, and he couldn't hit back. He would be handcuffed
3:01
His hands would be tied. It would absolutely affect the election. It would absolutely affect how he could campaign, and it would be really a violation of his
3:09
First Amendment freedoms. The judge making this decision is monumental. Make no mistake about it
3:17
I, for one, am thrilled to see that there's still parts of the judicial system, at least
3:23
that we can rely on. Folks, I want to know what you think about this
3:27
Hit me in the comments. Let me know, and let me know if you think this really bodes well for Trump down the line
3:32
I think it does. Also, please remember to like, share, and subscribe because, of course, that really
3:37
helps us out. I'm Carmine Sabia. This is Explain America. We love you guys
